3. A capital construction project completed by construction (reconstruction, major repairs) has the following parameters:

1. 3. To make a decision on issuing a permit to put a facility into operation, the following documents are required:

1) title documents for the land plot;

3) construction permit;

4) act of acceptance of a capital construction project (in the case of construction or reconstruction on the basis of a contract);

5) a document confirming the compliance of the constructed or reconstructed capital construction facility with the requirements of technical regulations and signed by the person carrying out the construction;

6) a document confirming the compliance of the parameters of the constructed or reconstructed capital construction project with design documentation, including the requirements for energy efficiency and the requirements for equipping the capital construction project with metering devices for energy resources used, and signed by the person carrying out the construction (the person carrying out the construction and the developer or technical by the customer in the case of construction, reconstruction on the basis of a contract, as well as by the person exercising construction control in the case of construction control on the basis of a contract), with the exception of cases of construction or reconstruction of individual housing construction projects;

9) conclusion of the state construction supervision body (if state construction supervision is provided) on the compliance of the constructed or reconstructed capital construction facility with the requirements of technical regulations and design documentation, including the requirements for energy efficiency and the requirements for equipping the capital construction facility with metering devices for the energy resources used , conclusion of the federal state environmental supervision in the cases provided for in Part 7 of Article 54 of this Code;

10) a document confirming the conclusion of an agreement on compulsory insurance of civil liability of the owner of a hazardous facility for harm caused by an accident at a dangerous facility in accordance with the legislation of the Russian Federation on compulsory insurance of civil liability of the owner of a dangerous facility for harm resulting from an accident at a hazardous facility;

11) act of acceptance of work performed to preserve a cultural heritage object, approved by the relevant body for the protection of cultural heritage objects, defined by Federal Law of June 25, 2002 N 73-FZ "On objects of cultural heritage (historical and cultural monuments) of the peoples of the Russian Federation", when carrying out restoration, conservation, repair of this object and its adaptation for modern use;

12) technical plan of a capital construction project, prepared in accordance with Federal Law of July 24, 2007 N 221-FZ “On the State Real Estate Cadastre”;

3.1. The document and conclusion specified in paragraphs 6 and 9 of part 3 of this article must contain information on the standard values ​​of the indicators included in the requirements for the energy efficiency of a capital construction project, and on the actual values ​​of such indicators determined in relation to the constructed, reconstructed capital construction project as a result of carried out research, measurements, examinations, tests, as well as other information on the basis of which the compliance of such an object with energy efficiency requirements and the requirements for its equipment with metering devices for energy resources used is established. During the construction or reconstruction of an apartment building, the conclusion of the state construction supervision body must also contain information about the energy efficiency class of the apartment building, determined in accordance with the legislation on energy saving and increasing energy efficiency.

3.2. Documents (their copies or information contained in them) specified in paragraphs 1, 2, 3 and 9 of part 3 of this article are requested by the bodies specified in part 2 of this article, in state bodies, local government bodies and subordinate state bodies or bodies local government organizations that have the specified documents at their disposal, if the developer has not submitted the specified documents independently.

3.3. The documents specified in paragraphs 1, 4, 5, 6, 7, 8, 12 and 13 of part 3 of this article are sent by the applicant independently, if these documents (their copies or information contained in them) are not at the disposal of public authorities, bodies local government or organizations subordinate to state bodies or local government bodies. If the documents specified in this part are at the disposal of state authorities, local self-government bodies or organizations subordinate to state authorities or local self-government bodies, such documents are requested by the body specified in part 2 of this article, from the bodies and organizations at the disposal of the specified documents, if the developer has not submitted these documents independently.

4. The Government of the Russian Federation may establish, in addition to those provided for in Part 3 of this article, other documents necessary to obtain permission to put a facility into operation, in order to obtain in full the information necessary to register a capital construction project with state registration.

4.1. To obtain permission to put a facility into operation, it is permitted to require only the documents specified in parts 3 and 4 of this article.

5. The body or authorized organization carrying out state management of the use of atomic energy and state management in carrying out activities related to the development, production, disposal of nuclear weapons and nuclear power plants for military purposes, or the State Corporation for Space Activities "Roscosmos", which issued a construction permit , within ten days from the date of receipt of the application for a permit to put the facility into operation, they are obliged to verify the availability and correctness of the documents specified in Part 3 of this article, inspect the capital construction project and issue the applicant a permit to put the facility into operation or refuse to issue such permission, indicating the reasons for refusal. During the inspection of a constructed or reconstructed capital construction facility, the compliance of such an object with the requirements established in the construction permit, the urban planning plan of the land plot, or in the case of construction, reconstruction of a linear facility, the territory planning project and the land surveying project, as well as the requirements of project documentation, is checked. including the requirements for energy efficiency and the requirements for equipping a capital construction project with metering devices for energy resources used, with the exception of cases of construction or reconstruction of an individual housing construction project. If during the construction or reconstruction of a capital construction project state construction supervision is carried out, an inspection of such an object by the body that issued the construction permit is not carried out.

6. The grounds for refusal to issue a permit to put an object into operation are:

1) absence of documents specified in part 3 of this article;

2) non-compliance of the capital construction project with the requirements of the urban planning plan of the land plot or, in the case of construction, reconstruction, major repairs of a linear facility, with the requirements of the territory planning project and the territory surveying project;

3) non-compliance of the capital construction project with the requirements established in the construction permit;

4) discrepancy between the parameters of the constructed or reconstructed capital construction facility and the design documentation. This basis does not apply to individual housing construction projects.

6.1. Failure to receive (untimely receipt) of documents requested in accordance with parts 3.2 and 3.3 of this article cannot be grounds for refusal to issue permission to put a facility into operation.

Compliance of the constructed capital construction project

The basis for refusal to issue a permit to put a facility into operation, in addition to the grounds specified in Part 6 of this article, is the developer’s failure to comply with the requirements provided for in Part 18 of Article 51 of this Code. In this case, permission to put the facility into operation is issued only after transfer free of charge to the federal executive body, executive body of the constituent entity of the Russian Federation, local government body or an authorized organization carrying out state management of the use of atomic energy and state management in carrying out activities related to the development , production, disposal of nuclear weapons and nuclear power plants for military purposes, or the State Corporation for Space Activities "Roscosmos", which issued a construction permit, information on the area, height and number of floors of the planned capital construction facility, on engineering and technical support networks, one a copy of a copy of the results of engineering surveys and one copy of each copy of sections of the design documentation provided for in clauses 2, 8 - 10 and 11.1 of part 12 of Article 48 of this Code, or one copy of a copy of the planning organization diagram of a land plot indicating the location of the individual housing construction project.

A permit to put a facility into operation (except for a linear facility) is issued to the developer if the federal executive body, the executive body of a constituent entity of the Russian Federation, a local government body or an authorized organization carrying out state management of the use of atomic energy and state management of carrying out activities related to the development, production, disposal of nuclear weapons and nuclear power plants for military purposes, or the State Corporation for Space Activities "Roscosmos", which issued a construction permit, was given a free copy of a diagram showing the location of the constructed, reconstructed capital construction facility, the location of networks engineering and technical support within the boundaries of the land plot and the planning organization of the land plot, for placing such a copy in the information system for supporting urban planning activities.

10. Permission to put a facility into operation is the basis for registering a constructed capital construction facility with the state, making changes to the state registration documents of a reconstructed capital construction facility.

10.1. A mandatory annex to the permit to put the facility into operation is the technical plan of the capital construction project submitted by the applicant, prepared in accordance with Federal Law of July 24, 2007 N 221-FZ “On the State Real Estate Cadastre”.

11. The permit to put a facility into operation must reflect information about the capital construction facility to the extent necessary for its state cadastral registration. The composition of such information must comply with the requirements established in accordance with Federal Law of July 24, 2007 N 221-FZ “On the State Real Estate Cadastre” for the composition of information in the graphic and text parts of the technical plan.

11.1. After completion of the construction of a capital construction project, the person carrying out the construction is obliged to transfer to the developer of such a project the results of engineering surveys, design documentation, inspection reports of work, structures, sections of engineering support networks for the capital construction project, and other documentation necessary for the operation of such a facility.

11.2. When carrying out work to preserve a cultural heritage site, permission to commission such a facility is issued taking into account the specifics established by the legislation of the Russian Federation on the protection of cultural heritage sites.

12. The form of permission to put a facility into operation is established by the federal executive body authorized by the Government of the Russian Federation.

13. Within three days from the date of issuance of the permit to put the facility into operation, the body that issued such permit shall send a copy of such permit to the federal executive body authorized to carry out state construction supervision, if a permit has been issued to put into operation capital facilities construction specified in paragraph 5.1 of Article 6 of this Code, or to the executive body of the constituent entity of the Russian Federation authorized to carry out state construction supervision, if permission has been issued for the commissioning of other capital construction projects.

Having completed the construction of a real estate project (RKS), reconstruction or major repairs, it can be put into operation only after receiving the appropriate permit, as is directly stated in Article 55 of the Town Planning Code.

Part 3 of this article requires the provision of a package of certain documents for this purpose, including a conclusion on compliance.

Conclusion of conformity (COC) is a document issued by the state construction supervision body (if this type of control is provided) and testifying to the compliance of the constructed or reconstructed capital construction facility with the requirements of technical regulations and design documentation, including energy efficiency requirements and requirements equipping the capital construction facility with metering devices for energy resources used.

The issuance of AIA is included in the list of government services provided (taking into account the affiliation that the object has) by federal or federal authorities. Founded by the Civil Code of the Russian Federation. Parts 3 and 4 of Art. 54.

This conclusion is issued by the regional body of Gosstroynadzor (GSN), is the final document and indicates that the completed facility fully meets the requirements of technical regulations and available design documentation. It should be remembered that, in accordance with the provisions of the current legislation, the regional State Supervision Authority begins to organize state supervision at the site, starting from the moment its construction begins (about which the relevant body is obliged to warn the technical customer or the developer himself by submitting a written notice). In a situation where, due to the fault of the developer, such supervision at the site was not organized, the State Tax Service has the right to refuse to issue the required document, since it cannot guarantee that all work performed will be carried out in accordance with the provisions of the current rules and regulations.

When construction was partially (at a separate stage) carried out by the developer without notifying representatives of the State Tax Service, it will become much more difficult to put such a facility into operation.

To legitimize an unauthorized construction, it will be necessary to conduct an independent examination with the involvement of a licensed organization. Its results will be transmitted to the State Service of Ukraine.

In such situations, the decision to issue a conclusion on compliance or to refuse to consider the application is made by the representative of the State Tax Service independently. There is no standard in Russia obliging us to accept these documents for consideration (as a legitimate assessment basis).

The preparation and issuance of an environmental impact assessment for a completed facility occurs in accordance with the requirements of the following legislative and departmental regulatory documents:

  • Town Planning Code. The text of the document was approved by Law 190-FZ, dated December 29, 2004 (as amended on April 23, 2018);
  • Federal Law 384-FZ, dated 12/30/09. The current version is dated 07/02/13;
  • Government Decree dated 02/01/06, registered under No. 54 (as amended on 02/28/18);
  • “Procedure for carrying out inspections at the facility” (RD-11-04-2006), approved by Order No. 1129, issued by Rostechnadzor on December 26, 2006 (as amended on July 14, 2015);
  • “Requirements for as-built documentation” (RD-11-02-2006), approved by order No. 1128, issued by Rostechnadzor on 12/26/06 (as amended on 11/09/17);
  • “Procedure for conducting business” (RD-11-03-2006), approved by order No. 1130, issued by Rostechnadzor on 12/26/06 (as amended on 10/21/15).

In addition to these documents, each subject of the federation develops its own regulations, the provisions of which are taken into account when drawing up a conclusion that the object meets all requirements.

1. The technical customer or developer submits a notice of completed construction (reconstruction) of the facility to the regional office of Gosstroynadzor. This is the requirement of clause 25 of RD-11-04-2006.

Notification is given only after the following points have been completed:

  • Completion of construction of the facility (its reconstruction or major repairs);
  • Elimination of violations identified at the facility;
  • Preparation of a package of as-built documentation, which is ongoing throughout construction.

Their complete list is given in RD-11-02-2006.

2. An authorized representative of the regional branch of Gosstroynadzor makes a decision to conduct a final inspection of the facility. The deadline for making a decision is seven working days, counting from the date of registration of the relevant notice.

The Gosstroynadzor official notifies the developer about the time of the inspection in accordance with the requirement of paragraph 9 of RD-11-04-2006. Duration of verification is up to 30 days.

Before it begins, the following types of work are carried out at the site (usually performed at the final stage of construction and installation work):

  • Provided tests of installed equipment (existing engineering systems). Their control launches in the presence of a customer representative;
  • Drawing up an acceptance certificate (when performing work to order), signed by the Customer and the Contractor's representative. Grounds, Civil Code of the Russian Federation, Article 753, paragraph 4.

The form of the act “KS-11” was approved and finalized in accordance with the resolutions of the State Committee for the Socialist Republic of Russia No. 71a (dated 10.30.97) and No. 100, dated 11.11.99.

As part of the test, additional testing blocks are:

  • checking the availability of necessary certificates from third parties who are interested authorities (for example: compliance with the requirements of the PUE and fire safety);
  • carrying out complex test runs of equipment installed at the facility (up to 72 hours of continuous operation in normal mode under rated loads).

During the period of inspection of the object, all necessary documentation is provided by the developer to the regional branch of Gosstroynadzor. Grounds, paragraph 4 RD-11-02-2006.

The list of necessary documents that need to be transferred is defined in the existing project documentation (clause 3 of RD-11-04-2006).

3. The results of the final inspection of the facility are documented in the “Capital Construction Object Inspection Report”.

This document serves as a legally legitimate basis for the customer’s right to apply for a conclusion (clause 27 RD-11-04-2006).

4. After receiving the Inspection Certificate for the completed construction of the OKS, the technical customer contacts the regional office of Gosstroynadzor (in writing, in any form) with a request to issue an AIA (clause 27 RD-11-04-2006).

The application must be accompanied by:

  • “Act” signed by a representative of the State Tax Service;
  • Certificate of acceptance of the object (when the latter is built in accordance with the concluded agreement).

5. The regional office of Gosstroynadzor issues the required Certificate of Compliance (FCA) to the applicant. Duration: ten working days, counting from the moment of registration of the received application.

If there are legally required reasons, then a reasoned refusal to issue the required document on the compliance of buildings and structures with the requirements imposed on them by current documents is sent to the applicant.

When can you get rejected?

There are only two reasons to refuse to issue an applicant the necessary conclusion.

  1. During the construction of the facility, a number of violations occurred (for example, non-compliance with the requirements of the current technical regulations, joint ventures and standards), and as of the date of issue of the document they had not been eliminated.
  2. After completion of the work, an “Inspection Report” was not issued.

There are no other grounds provided for by law.

What you need to pay attention to during work

To guarantee obtaining a certificate of conformity, the following is required:

  • Compliance of all work performed with the provisions of current standards;
  • Compliance with design documentation. This point is often omitted when, during the construction process, it is quickly necessary to make adjustments to one or another design solution, or to change the materials used.

It all depends on the nature of the changes made to the PD during construction; in some cases, it is necessary to re-examine the design documentation before handing over the project.

The work must be coordinated with the designers performing architectural supervision (must be documented).

Of course, we all ultimately want to receive from the SSN authorities a conclusion on the compliance of the constructed or reconstructed capital construction facility with the requirements of technical regulations, other regulatory legal acts and design documentation, including the requirements for energy efficiency and the requirements for equipping the capital construction facility with metering devices for the energy resources used.

What it is?

According to Part 3 of Art. 55 of the Civil Code of the Russian Federation, for objects it is necessary to submit a list of documents, including a conclusion on compliance issued by the GSN authorities.

If someone gives you permission to enter in the absence of this document, then he will be brought to administrative responsibility under Part 4 of Art. 9.5 Code of Administrative Offenses of the Russian Federation. They may also appeal your permission to enter and have it revoked.

This document is issued by the SSN authorities based on the results of implementation during construction. reconstruction of state construction supervision in accordance with the requirements of Art. 54 Civil Code of the Russian Federation. If you did not notify the SSN authorities about the start of construction and state construction supervision was not carried out at your site, then you will not be given a certificate of compliance.
