Updated SNiPs - SP (2011-2013)

In accordance with Article 5 Federal Law N 384-FZ "Technical Regulations on the Safety of Buildings and Structures" the safety of buildings and structures must be ensured by means of compliance with the Federal Law and the requirements of standards and codes of practice, which are included in:

List of national standards and SPs, the application of which, on a mandatory basis, ensures compliance with the requirements of the Federal Law, approved by Order of the Government of the Russian Federation of June 21, 2010 N1047-r;

A list of documents in the field of standardization, as a result of which, on a voluntary basis, compliance with the requirements of the Federal Law, approved by Order of Rostekhregulirovaniye dated June 1, 2010 N2079, is ensured. Updated SNIPs that were not included in the above-mentioned Lists are documents of voluntary use.

The Ministry of Regional Development of Russia, by its Order No. 447 of October 14, 2010, determined the contractor for the production and distribution of sets of rules. It became the “Federal Center for Standardization, Standardization and technical assessment compliance in construction" (FAI "FCS").

In accordance with paragraph 31 of the Rules for the development and approval of sets of rules approved by Government Decree Russian Federation dated November 19, 2008 N 858: “References to sets of rules in the developed and applied documentation are made only if there are officially published copies of the sets of rules. Officially published sets of rules are publications of the FAA "FCS". FAU "FCS", in close cooperation with the Ministry of Regional Development of the Russian Federation, developers, Rosstandart, TK 465, are obliged to coordinate all work on updating SNiP.

Clause 1 of Article 6 of the Technical Regulations on the Safety of Buildings and Structures states that the Government of the Russian Federation approves a list of national standards and codes of practice (parts of such standards and codes of practice), as a result of which, on a mandatory basis, compliance with the requirements of the Technical Regulations on the safety of buildings and structures is ensured. structures.

By Order of the Government of the Russian Federation dated June 21, 2010 N 1047-r, the List of national standards and codes of rules (parts of such standards and codes of rules) was approved, as a result of which, on a mandatory basis, compliance with the requirements of the Federal Law "Technical Regulations on the Safety of Buildings and Structures" is ensured ( hereinafter referred to as List No. 1047-r).

Decree of the Government of the Russian Federation dated December 26, 2014 N 1521 adopted a new List of national standards and codes of practice (parts of such standards and codes of practice), as a result of which, on a mandatory basis, compliance with the requirements of the Federal Law "Technical Regulations on the Safety of Buildings and Structures" (hereinafter referred to as - List No. 1521). The new list, unlike List N 1047-r, which contains references to SNiPs, contains references to SP (updated editions of SNiPs). Also, some GOSTs and SNiPs were removed from the new List and newly introduced ones were added.

Instead of the List of documents in the field of standardization, as a result of which, on a voluntary basis, compliance with the requirements of the Federal Law of December 30, 2009 N 384-FZ “Technical Regulations on the Safety of Buildings and Structures” is ensured (approved by order of Rostekhregulirovanie dated June 1, 2010 N 2079) On July 1, 2015, the List of documents in the field of standardization came into force, as a result of which, on a voluntary basis, compliance with the requirements of the Federal Law “Technical Regulations on the Safety of Buildings and Structures” (approved by Order of Rosstandart dated March 30, 2015 N 365) was ensured.

Design documentation and (or) engineering survey results accepted by the developer or technical customer, the development of which began before July 1, 2015 and which are submitted for initial or repeated state or non-state examination project documentation and (or) the results of engineering surveys are checked for compliance with national standards and codes of practice (parts of such standards and codes of practice) included in the list approved by Decree of the Government of the Russian Federation dated June 21, 2010 N 1047-r. In accordance with Decree of the Government of the Russian Federation dated September 29, 2015 N 1033, design documentation and (or) engineering survey results accepted by the developer or technical customer, the development of which began in the period from July 1, 2015 before the entry into force of this resolution and which are submitted for primary or repeated state or non-state examination of design documentation and (or) engineering survey results are checked for compliance with national standards and codes of practice (parts of such standards and codes of practice), included in the list of national standards and codes of practice (parts of such standards and codes of practice), as a result the application of which on a mandatory basis ensures compliance with the requirements of the Federal Law "Technical Regulations on the Safety of Buildings and Structures", approved by Decree of the Government of the Russian Federation of December 26, 2014 N 1521 "On approval of the list of national standards and sets of rules (parts of such standards and sets of rules), as a result of the application of which, on a mandatory basis, compliance with the requirements of the Federal Law "Technical Regulations on the Safety of Buildings and Structures" is ensured, without taking into account the changes approved by this resolution.

on the application of a list of national standards and codes of practice (parts of such standards and codes of practice), as a result of which, on a mandatory basis, compliance with the requirements of the Federal Law “Technical Regulations on the Safety of Buildings and Structures”, approved by the Decree of the Government of the Russian Federation of December 26, 2014, is ensured. 1. These Methodological Recommendations have been prepared in accordance with paragraph 3 of the Decree of the Government of the Russian Federation of December 26, 2014 No. 1521 “On approval of the list of national standards and sets of rules (parts of such standards and sets of rules), as a result of which, on a mandatory basis, compliance is ensured requirements of the Federal Law “Technical Regulations on the Safety of Buildings and Structures” (hereinafter referred to as the resolution, list) and determine the rules for applying the list when performing engineering surveys, carrying out architectural and construction design, construction, conducting examination of engineering surveys, design documentation, implementing state construction supervision, as well as supervision at the stage of operation of facilities capital construction.

2. The provisions contained in these Methodical recommendations, are recommended for use by organizations and enterprises, regardless of departmental affiliation, forms of ownership and sources of construction financing.

3. The resolution defines a list of documents in the field of standardization (their parts), the requirements of which must be observed when performing engineering surveys, carrying out architectural and construction design, construction, operation and demolition of capital construction projects.

4. The provisions of documents in the field of standardization included in the list are not mandatory in relation to the following buildings and structures until their reconstruction or major repairs:

to buildings and structures, construction, reconstruction and major renovation which are carried out in accordance with project documentation approved or submitted for examination before July 1, 2015;

for buildings and structures for which design documentation is not subject to examination and an application for a construction permit is submitted before July 1, 2015.

5. If the provisions of documents in the field of standardization (their parts) included in the list establish a requirement to undergo administrative procedures not provided for by regulatory legal acts when performing engineering surveys, carrying out architectural and construction design, construction, operation, demolition of a capital construction project Russian Federation, such a requirement of a document in the field of standardization (its part) does not apply.

An administrative procedure should be understood as a method of interaction between the developer (technical customer) or a person authorized by him (performer of a specific type of work) and state authorities, local governments, other bodies or organizations performing the functions of these persons, organizations participating in the provision of state or municipal services , organizations communal complex, electric grid and gas supply companies for the purpose of performing legally significant actions, including those related to the provision of documents by the developer (technical customer) or his authorized person and (or) payment of a fee.

When performing administrative procedures in the field of housing construction, one should be guided by the Decree of the Government of the Russian Federation dated April 30, 2014 No. 403 “On an exhaustive list of procedures in the field of housing construction.”

6. Changes made to the documents included in the list in the field of standardization (parts thereof) in the process of their updating, in accordance with the legislation of the Russian Federation on technical regulation, are applied on a voluntary basis.

Such changes will be applied on a mandatory basis only after changes have been made to the list.

When making changes to the list, along with the main name of the document, its edition is indicated.

7. If a requirement contained in a document included in the list in the field of standardization (part of it) is formulated as a recommendation (contains an indication of the need to comply with the requirement with the wording “as a rule”, “with appropriate justification”, “in case of special need” ", "preferably", "recommended", "preferably", "may", "in necessary cases"and the like), the decision to fulfill such a requirement is made by the developer (technical customer) or his authorized person (performer of a specific type of work).

8. Documents in the field of standardization (parts thereof), which are referenced in codes of practice and national standards (parts thereof) included in the list, are applied on a mandatory basis only if these documents (parts thereof) are contained in the list.

9. From the date of entry into force of the list, documents not included in the list in the field of standardization containing requirements for buildings and structures (the engineering support networks and systems of engineering support included in them), as well as processes related to buildings and structures design (including surveys), construction, installation, commissioning, operation and disposal (demolition), are applied on a voluntary basis.

10. Appendices to documents in the field of standardization included in the list are applied on a mandatory basis only if these appendices are included in the list.

Document overview

A new list of national standards and sets of rules (their parts) was approved, as a result of which, on a mandatory basis, compliance with the requirements of technical regulations on the safety of buildings and structures is ensured. It will come into effect on July 1, 2015.

It has been established how this list is applied.

Thus, the requirements of the documents in the field of standardization (their parts) given in the list must be observed when engineering surveys, architectural and construction design, construction, operation and demolition of capital construction projects. However, they are not mandatory for the following buildings and structures. Firstly, those put into operation before July 1, 2015. Secondly, those whose construction, reconstruction and overhaul are carried out in accordance with design documentation approved or submitted for examination before the specified date. Thirdly, buildings and structures for which design documentation is not subject to examination and an application for a construction permit was submitted before July 1, 2015.

If the documents from the list establish a requirement to undergo administrative procedures during the above-mentioned work that are not provided for Russian legislation, it is not executed.

Changes made to documents from the list are applied on a voluntary basis. Such amendments will become mandatory only after changes are made to the list.

If the requirement of a document included in the list is advisory, whether to fulfill it or not is decided by the developer (technical customer) or a person authorized by him (performer of a specific type of work).

Documents in the field of standardization (parts thereof), to which codes of practice and national standards refer, are applied in mandatory only if they are on the list.

Appendices to documents included in the list are executed on a mandatory basis according to the same principle. They should be on the list.
