In accordance with paragraph 1 of Art. 12 of the Law of the Russian Federation “On Education”, an educational organization that carries out the educational process, i.e. implementing one or more educational programs and / or providing maintenance and education of students, pupils, is created in the legal form of an educational institution. Literal reading of the text of paragraph 3 of Art. 12 of the Law of the Russian Federation "On Education" makes it possible to single out the following legal organizational and legal forms of an educational organization:

state educational institution,

non-state educational institution,

municipal educational institution.

The concept of an educational institution as an organizational and legal form introduced by the Law of the Russian Federation “On Education” is not a kind of institution as a separate type of legal entity established by the Civil Code of the Russian Federation. Thus, the norms of the Civil Code of the Russian Federation, which fix the legal status of an institution as such, should not be applied, at least in full, to educational institutions.

In the course of the ongoing reform (modernization) of Russian education, opinions are increasingly being expressed about the need for the widespread introduction of a new organizational and legal form for the creation and functioning of educational institutions - ANO (autonomous non-profit organization), provided for by Art. 10 Law the federal law dated January 12, 1996 N 7-FZ "On non-profit organizations". This type of civil law status is characterized by the following.

1. The property of an autonomous non-profit organization (ANO), formed at the expense of voluntary contributions from its founders, becomes the property of the ANO itself. It should be noted that the Law on Non-Commercial Organizations does not exclude the sole founding of an ANO.

2. The supreme governing body of the ANO, which has exclusive competence, is the collegiate supreme body (clause 1, article 29 of the Law on Non-Commercial Organizations). It includes both founders and employees, who cannot make up more than one third of the members of this supreme governing body (clause 5, article 29 of the Law on Non-Commercial Organizations). The founders are not liable for the obligations of the ANO created by them, and it, in turn, is not liable for the obligations of the founders. At the same time, the Law on Non-Commercial Organizations (clause 3, article 10) requires the founders to supervise the activities of ANOs, the procedure for which must be provided for by the constituent documents of ANOs.

3. The competence of the supreme body of the ANO, fully established by law, includes such issues as: changing the charter of the ANO; determination of priority directions of the organization's activity, principles of formation and use of its property; formation of executive bodies and early termination of their powers; approval of the annual report and annual balance sheet; approval of the financial plan of the non-profit organization; creation of branches and opening of representative offices; participation in other organizations; reorganization and liquidation of ANO.

4. ANO occupies, in fact, some intermediate position between organizations, both created on the principles of participation of members, and those that do not have membership.
