decides:

1. Approve the attached Rules for approval by the Federal Agency for Fisheries of the construction and reconstruction of capital construction projects, the introduction of new technological processes and the implementation of other activities that affect aquatic biological resources and their habitat.

2. Recognize as invalid (Sobraniye zakonodatelstva Rossiyskoy Federatsii, 2008, N 31, art. 3740).

Rules for approval by the Federal Agency for Fisheries of the construction and reconstruction of capital construction projects, the introduction of new technological processes and the implementation of other activities that affect aquatic biological resources and their habitat

1. These Rules establish the procedure for approval by the Federal Fisheries Agency (its territorial bodies) of the construction and reconstruction of capital construction projects, the introduction of new technological processes and the implementation of other activities that affect aquatic biological resources and their habitat (hereinafter referred to as other activities).

2. The Federal Fisheries Agency coordinates:

a) construction and reconstruction of capital construction projects in the internal sea waters of the Russian Federation, in the territorial sea of ​​the Russian Federation, on the continental shelf of the Russian Federation, in the exclusive economic zone Russian Federation, project documentation which is the object of state environmental expertise;

b) the introduction of new technological processes and the implementation of other activities in the internal sea waters of the Russian Federation, in the territorial sea of ​​the Russian Federation, on the continental shelf of the Russian Federation, in the exclusive economic zone of the Russian Federation, as well as in the case of the introduction of these processes and the implementation of other activities in the territory of two and more subjects of the Russian Federation and in transboundary water bodies.

3. Territorial bodies of the Federal Agency for Fisheries coordinate:

a) construction and reconstruction of capital construction objects - in the case of construction and reconstruction of these objects on the territory of one subject of the Russian Federation;

b) the introduction of new technological processes and the implementation of other activities - in the case of the introduction of these processes and the implementation of other activities on the territory of one subject of the Russian Federation.

4. Legal entities and individuals, including individual entrepreneurs(hereinafter - the applicants), in order to coordinate the construction and reconstruction of capital construction projects, the introduction of new technological processes and the implementation of other activities, submit to the Federal Agency for Fisheries (its territorial bodies) an application for approval (hereinafter - the application), in which the following information is indicated:

a) about the applicant:

full and abbreviated (if available) names legal entity, its legal form and location;

surname, name, patronymic and place of residence individual(individual entrepreneur);

b) about the documentation attached to the application.

5. The following documentation is attached to the application:

a) upon approval of the construction and reconstruction of capital construction facilities in accordance with paragraphs 2 and 3 of these Rules - a copy of the sections of the design documentation provided for in paragraphs 10, , , - (for capital construction facilities for industrial and non-industrial purposes, with the exception of linear facilities) and paragraphs 34 - (for linear facilities) Regulations on the composition of sections of project documentation and requirements for their content, approved by Decree of the Government of the Russian Federation of February 16, 2008 N 87;

b) when agreeing on the introduction of new technological processes and the implementation of other activities in accordance with paragraphs 2 and 3 of these Rules - a copy of the design documentation or a program of planned work justifying the introduction of new technological processes and the implementation of other activities, as well as a document containing information on the planned measures to conservation of aquatic biological resources and their habitat.

6. The application and the documentation attached to it, specified in paragraph 5 of these Rules (hereinafter referred to as the documentation), are submitted by the applicant to the Federal Fisheries Agency (its territorial bodies) directly or sent by post with a list of attachments or in the form electronic document signed by enhanced qualified electronic signature, using information and telecommunication networks common use, including federal state information system"Single portal of state and municipal services (functions)".

Application form sent to in electronic format, and the procedure for its submission are established by the Ministry Agriculture Russian Federation.

7. The application and documentation received by the Federal Agency for Fisheries (its territorial bodies) are registered on the day they are received.

8. The Federal Agency for Fisheries (its territorial bodies) considers the application and documentation and makes a decision on approval (on refusal to approve) the construction and reconstruction of capital construction facilities, the introduction of new technological processes and the implementation of other activities (hereinafter referred to as activities) on time, not exceeding 30 calendar days from the date of receipt by the Federal Agency for Fisheries (its territorial bodies) of the application and documentation.

9. The decision to approve (refuse to approve) activities is drawn up in the form of a conclusion, which is signed by the head or an authorized deputy head of the Federal Fisheries Agency (its territorial body) and contains the following information:

A) short description activities and characteristics of its impact on aquatic biological resources and their habitat;

b) measures for the conservation of aquatic biological resources and their habitat, planned in accordance with the documentation;

c) the conditions and restrictions necessary to prevent or reduce the negative impact of activities on aquatic biological resources and their habitat (conditions for water intake and wastewater disposal, working conditions in water protection and fish protection zones, coastal protective strip water body and fishery protected area, restrictions on the timing and methods of work in the water area and other conditions);

d) conclusions about the admissibility of the impact of activities on the state of aquatic biological resources and their habitat;

e) a decision to approve (refuse to approve) the implementation of activities;

10. The decision to approve (refuse to approve) the implementation of activities is communicated to the applicant in the form in which the application and documentation were submitted (by post or in the form of an electronic document signed with an enhanced qualified electronic signature of the authorized official Federal Agency for Fisheries (its territorial body).

11. The decision of the Federal Agency for Fisheries (its territorial body) to refuse to coordinate the implementation of activities must contain the grounds for refusal.

12. The grounds for refusal to approve the implementation of activities are:

a) submission to the Federal Agency for Fisheries (its territorial bodies) not in in full documentation;

b) non-compliance of documentation with the requirements of legislation on fishing and conservation of aquatic biological resources, water legislation, as well as legislation in the field of protection environment on the conservation of aquatic biological resources and their habitat.

13. In case of refusal to approve activities, applicants may re-submit the application and documentation to the Federal Agency for Fisheries (its territorial bodies), subject to the revision of the documentation, taking into account the comments and recommendations provided for in the decision to refuse to approve activities.

1. b) when agreeing on the introduction of new technological processes and the implementation of other activities in accordance with paragraphs 2 and 3 of these Rules - a copy of the design documentation or a program of planned work justifying the introduction of new technological processes and the implementation of other activities, as well as a document containing information on the planned measures to conservation of aquatic biological resources and their habitat.

e) a decision to approve (refuse to approve) the implementation of activities;

10. The decision to approve (refuse to approve) the implementation of activities is communicated to the applicant in the form in which the application and documentation were submitted (by post or in the form of an electronic document signed with an enhanced qualified electronic signature of an authorized official of the Federal Agency for Fisheries (his territorial authority).

11. The decision of the Federal Agency for Fisheries (its territorial body) to refuse to coordinate the implementation of activities must contain the grounds for refusal.

12. The grounds for refusal to approve the implementation of activities are:

a) submission to the Federal Agency for Fisheries (its territorial bodies) incomplete documentation;

b) non-compliance of documentation with the requirements of the legislation on fishery and conservation of aquatic biological resources, water legislation, as well as legislation in the field of environmental protection on the conservation of aquatic biological resources and their habitat.

13. In case of refusal to approve activities, applicants may re-submit the application and documentation to the Federal Agency for Fisheries (its territorial bodies), subject to the revision of the documentation, taking into account the comments and recommendations provided for in the decision to refuse to approve activities.

STATE REGISTRATION OF AGREEMENTS ON DISPOSITION

EXCLUSIVE RIGHT TO BREEDING ACHIEVEMENT

AND THE TRANSFER OF SUCH RIGHT WITHOUT A CONTRACT


1. These Rules establish the procedure and conditions for the state registration of agreements on the disposal of the exclusive right to a selection achievement, as well as the transfer of such a right without an agreement.

2. The following agreements on disposal of the exclusive right to a selection achievement are subject to state registration:

an agreement on the alienation of the exclusive right to a selection achievement (hereinafter referred to as the agreement on the alienation of a patent);

an agreement on pledge of the exclusive right to a selection achievement;

an agreement on granting the right to use a selection achievement.

State registration is subject to changes relating to the essential terms of the registered agreement on the disposal of the exclusive right to a selection achievement, termination of the registered agreement on the disposal of the exclusive right to a selection achievement (hereinafter - the termination of the registered agreement), as well as the transfer of the exclusive right to a selection achievement without an agreement (hereinafter - the transition exclusive right).

3. State registration of agreements, amendments and transfer of the exclusive right provided for in paragraph 2 of these Rules is carried out by the Ministry of Agriculture of the Russian Federation subject to the following conditions:

a) submission of documents in respect of registered breeding achievements, the legal protection of which has not been terminated or invalidated in accordance with the established procedure;

b) compliance of the information provided on the subject of the agreement (patent number, name of the selection achievement, scope of legal protection, duration of the exclusive right), the right holder (patent owner) and the parties to the agreement with the information contained in the State Register of Protected Selection Achievements;

c) the presence in the compensated agreement on the alienation of a patent or an agreement on granting the right to use a selection achievement of a condition on remuneration or the procedure for determining it.

4. For state registration of contracts, amendments and termination of registered contracts provided for in paragraph 2 of these Rules, a citizen or legal entity that is one of the parties to the contract, or their representative, shall submit the following documents to the Ministry of Agriculture of the Russian Federation:

b) a document confirming the payment of the fee in the prescribed amount (for a patent alienation agreement in respect of which there is a public offer to conclude a patent alienation agreement, also a document confirming the payment of all patent fees from which the applicant (patent holder) was exempted);

c) a power of attorney certifying the authority of a representative of a citizen or legal entity that is one of the parties to the agreement (in the case of conducting business through a representative);

d) 3 copies of the contract relating to one selection achievement (1 copy of the contract remains for storage in the Ministry of Agriculture of the Russian Federation and 1 copy is transferred to the parties to the contract or their representatives).

5. For state registration of unilateral termination of a registered contract, a citizen or legal entity that is one of the parties to the contract, or their representative, shall submit the documents provided for in subparagraphs "a" - "c" of paragraph 4 of these Rules.

In case of termination of the registered contract on the basis of a court decision, the corresponding court decision is additionally attached to the specified documents.

6. For state registration of the transfer of an exclusive right, a citizen or a legal entity or their representative shall submit the following documents to the Ministry of Agriculture of the Russian Federation:

a) an application for state registration;

b) a document confirming the payment of the fee in the prescribed amount;

c) a power of attorney certifying the authority of a representative of a citizen or legal entity (in the case of conducting business through a representative);

d) documents confirming the transfer of the exclusive right.

7. For state registration, the original documents specified in paragraphs 4-6 of these Rules, or their notarized copies that do not have erasures and (or) additions, crossed out words and other corrections not specified in them, are submitted.

If the document consists of more than 1 sheet, the sheets of the document are numbered and stitched.

The submitted documents must have the signatures of the parties or officials determined by the legislation of the Russian Federation. The names of legal entities are indicated without abbreviations, indicating their location, surnames, first names and patronymics of individuals and their addresses of residence are indicated in full.

Documents may be submitted in Russian or a foreign language. If the documents are submitted in a foreign language, they are accompanied by a translation into Russian, certified in the prescribed manner.

8. The Ministry of Agriculture of the Russian Federation considers an application for state registration of contracts, amendments, termination of registered contracts and transfer of the exclusive right provided for in paragraph 2 of these Rules within 20 working days from the date of receipt of the complete set of documents provided for in paragraphs 4 - 6 of these Rules, and, based on the results of consideration, performs state registration or refuses such registration if the conditions provided for by these Rules are not met.

In case of refusal of state registration, the Ministry of Agriculture of the Russian Federation notifies the person who submitted the application for state registration of this within the specified period in writing, indicating the reasons for the refusal.

9. During the state registration of contracts, amendments, termination of the registered contract and transfer of the exclusive right provided for in paragraph 2 of these Rules, the Ministry of Agriculture of the Russian Federation enters the relevant information into State Register of protected selection achievements, publishes in the next issue of the official bulletin information on state registration entered in the State Register of protected selection achievements, and also notifies in writing the person who submitted the application for state registration within 3 days from the date of state registration.

The application and the documentation attached to it specified in these Rules (hereinafter referred to as the documentation) are submitted by the applicant to the Federal Fisheries Agency (its territorial bodies) directly or sent by post with a description of the attachment or in the form of an electronic document signed with an enhanced qualified electronic signature , using public information and telecommunication networks, including the federal state information system "Unified Portal of State and Municipal Services (Functions)".

The form of the application sent in electronic form and the procedure for its submission are established by the Ministry of Agriculture of the Russian Federation.

7. The application and documentation received by the Federal Agency for Fisheries (its territorial bodies) are registered on the day they are received.

8. The Federal Agency for Fisheries (its territorial bodies) considers the application and documentation and makes a decision on approval (on refusal to approve) the construction and reconstruction of capital construction facilities, the introduction of new technological processes and the implementation of other activities (hereinafter referred to as activities) on time, not exceeding 30 calendar days from the date of receipt by the Federal Agency for Fisheries (its territorial bodies) of the application and documentation.

9. The decision to approve (refuse to approve) activities is drawn up in the form of a conclusion, which is signed by the head or an authorized deputy head of the Federal Fisheries Agency (its territorial body) and contains the following information:

a) a brief description of the activity and a description of its impact on aquatic biological resources and their habitat;

b) measures for the conservation of aquatic biological resources and their habitat, planned in accordance with the documentation;

c) the conditions and restrictions necessary to prevent or reduce the negative impact of activities on aquatic biological resources and their habitat (conditions for water intake and wastewater disposal, working conditions in the water protection and fish protection zones, the coastal protective zone of a water body and the fishery reserve zone, restrictions on the timing and methods of work in the water area and other conditions);

d) conclusions about the admissibility of the impact of activities on the state of aquatic biological resources and their habitat;

e) a decision to approve (refuse to approve) the implementation of activities;

10. The decision to approve (refuse to approve) the implementation of activities is communicated to the applicant in the form in which the application and documentation were submitted (by post or in the form of an electronic document signed with an enhanced qualified electronic signature of an authorized official of the Federal Agency for Fisheries (his territorial authority).

11. The decision of the Federal Agency for Fisheries (its territorial body) to refuse to coordinate the implementation of activities must contain the grounds for refusal.

12. The grounds for refusal to approve the implementation of activities are:

a) submission to the Federal Agency for Fisheries (its territorial bodies) incomplete documentation;

b) non-compliance of documentation with the requirements of the legislation on fishery and conservation of aquatic biological resources, water legislation, as well as legislation in the field of environmental protection on the conservation of aquatic biological resources and their habitat.

13. In case of refusal to approve activities, applicants may re-submit the application and documentation to the Federal Agency for Fisheries (its territorial bodies), subject to the revision of the documentation, taking into account the comments and recommendations provided for in the decision to refuse to approve activities.

The Decree of the Government of the Russian Federation on the approval of the Rules for coordinating the placement of economic and other facilities, as well as the introduction of new technological processes that affect the state of aquatic biological resources and their habitat, has been declared invalid.
