1. Approve the attached Approval Rules Federal agency for fisheries construction and reconstruction of facilities capital construction, introduction of new technological processes and carrying out other activities that have an impact on aquatic biological resources and their habitat.

2. Recognize as invalid the Decree of the Government of the Russian Federation of July 28, 2008 N 569 “On approval of the Rules for approving the placement of economic and other facilities, as well as the introduction of new technological processes affecting the state of aquatic biological resources and their habitat” (Collection of Legislation of the Russian Federation) Federation, 2008, N 31, Article 3740).

Rules for approval by the Federal Fisheries Agency of the construction and reconstruction of capital construction projects, the introduction of new technological processes and the implementation of other activities that have an impact on aquatic biological resources and their habitats

1. These Rules establish the procedure for approval by the Federal Fisheries Agency (its territorial bodies) of the construction and reconstruction of capital construction projects, the introduction of new technological processes and the implementation of other activities that have an impact on aquatic biological resources and their habitat (hereinafter referred to as other activities).

2. The Federal Fisheries Agency coordinates:

A) construction and reconstruction of capital construction projects in the internal sea waters of the Russian Federation, in the territorial sea of ​​the Russian Federation, on the continental shelf of the Russian Federation, in the exclusive economic zone Russian Federation, project documentation which is the object of state environmental assessment;

B) the introduction of new technological processes and the implementation of other activities in the internal sea waters of the Russian Federation, in the territorial sea of ​​the Russian Federation, on the continental shelf of the Russian Federation, in the exclusive economic zone of the Russian Federation, as well as in the case of the introduction of these processes and the implementation of other activities in the territory of two and more constituent entities of the Russian Federation and in transboundary water bodies.

3. Territorial bodies of the Federal Fisheries Agency coordinate:

A) construction and reconstruction of capital construction projects - in the case of construction and reconstruction of these facilities on the territory of one constituent entity of the Russian Federation;

B) introduction of new technological processes and implementation of other activities - in the case of implementation of these processes and implementation of other activities on the territory of one constituent entity of the Russian Federation.

4. Legal entities and individuals, including individual entrepreneurs(hereinafter referred to as the applicants), in order to approve the construction and reconstruction of capital construction projects, introduce new technological processes and carry out other activities, submit to the Federal Fisheries Agency (its territorial bodies) an application for approval (hereinafter referred to as the application), in which they indicate the information:

A) about the applicant:

Full and abbreviated (if available) names legal entity, its organizational and legal form and location;
last name, first name, patronymic and place of residence individual(individual entrepreneur);

B) about the documentation attached to the application.

5. The following documentation is attached to the application:

A) when approving the construction and reconstruction of capital construction projects in accordance with paragraphs 2 and 3 of these Rules - a copy of the sections of the design documentation provided for in paragraphs 10, 12, 17, 18, 22-25 (for capital construction projects for production and non-production purposes, with the exception linear objects) and paragraphs 34-40 (for linear objects) of the Regulations on the composition of sections of project documentation and requirements for their content, approved by Decree of the Government of the Russian Federation of February 16, 2008 N 87;

B) when agreeing on the introduction of new technological processes and the implementation of other activities in accordance with paragraphs 2 and 3 of these Rules - a copy of the project documentation or program of planned work justifying the introduction of new technological processes and the implementation of other activities, as well as a document containing information on planned measures for conservation of aquatic biological resources and their habitat.

6. The application and the documentation attached to it, specified in paragraph 5 of these Rules (hereinafter referred to as the documentation), are submitted by the applicant to the Federal Fishery Agency (its territorial bodies) directly or sent by mail with a list of the contents or in the form electronic document, signed by a strengthened qualified electronic signature, using information and telecommunication networks common use, including federal state information system"Unified portal of state and municipal services (functions)."

Application form sent to in electronic format, and the procedure for its submission is established by the Ministry Agriculture Russian Federation.

7. The application and documentation received by the Federal Fisheries Agency (its territorial bodies) are registered on the day of their receipt.

8. The Federal Fisheries Agency (its territorial bodies) reviews the application and documentation and makes a decision on approval (or refusal to approve) the construction and reconstruction of capital construction projects, the introduction of new technological processes and the implementation of other activities (hereinafter referred to as activities) on time, not exceeding 30 calendar days from the date of receipt by the Federal Fisheries Agency (its territorial bodies) of the application and documentation.

9. The decision to approve (refuse to approve) an activity is drawn up in the form of a conclusion, which is signed by the head or authorized deputy head of the Federal Fisheries Agency (its territorial body) and contains the following information:

A) short description activity and characteristics of its impact on aquatic biological resources and their habitat;

B) measures for the conservation of aquatic biological resources and their habitats, planned in accordance with the documentation;

C) conditions and restrictions necessary to prevent or reduce negative impact activities on aquatic biological resources and their habitat (conditions for water intake and wastewater disposal, working conditions in water protection and fisheries protection zones, coastal protective strip water body and fishery reserve zone, restrictions on the timing and methods of work in the water area and other conditions);

D) conclusions about the admissibility of the influence of activities on the state of aquatic biological resources and their habitat;

D) decision on approval (or refusal to approve) the implementation of activities;

10. The decision to approve (refuse to approve) the implementation of activities is communicated to the applicant in the form in which the application and documentation were submitted (by mail or in the form of an electronic document signed with an enhanced qualified electronic signature of the authorized official Federal Fishery Agency (its territorial body).

11. The decision of the Federal Fisheries Agency (its territorial body) to refuse approval for the implementation of activities must contain the grounds for the refusal.

12. The grounds for refusal to approve the implementation of activities are:

A) submission to the Federal Fishery Agency (its territorial bodies) is not in full documentation;

B) non-compliance of documentation with the requirements of legislation on fishing and the conservation of aquatic biological resources, water legislation, as well as legislation in the field of environmental protection on the conservation of aquatic biological resources and their habitat.

13. In case of refusal to approve the activity, applicants may re-submit the application and documentation to the Federal Fisheries Agency (its territorial bodies) provided that the documentation is finalized taking into account the comments and recommendations provided for in the decision to refuse approval to carry out the activity.

These Rules establish the procedure for approval by the Federal Fisheries Agency (its territorial bodies) of the construction and reconstruction of capital construction projects, the introduction of new technological processes and the implementation of other activities that have an impact on aquatic biological resources and their habitat (hereinafter referred to as other activities).

2. The Federal Fisheries Agency coordinates:

a) construction and reconstruction of capital construction projects in the internal sea waters of the Russian Federation, in the territorial sea of ​​the Russian Federation, on the continental shelf of the Russian Federation, in the exclusive economic zone of the Russian Federation, the design documentation of which is the subject of state environmental impact assessment;

b) the introduction of new technological processes and the implementation of other activities in the internal sea waters of the Russian Federation, in the territorial sea of ​​the Russian Federation, on the continental shelf of the Russian Federation, in the exclusive economic zone of the Russian Federation, as well as in the case of the introduction of these processes and the implementation of other activities in the territory of two and more constituent entities of the Russian Federation and in transboundary water bodies.

3. Territorial bodies of the Federal Fisheries Agency coordinate:

a) construction and reconstruction of capital construction projects - in the case of construction and reconstruction of these facilities on the territory of one constituent entity of the Russian Federation;

b) introduction of new technological processes and implementation of other activities - in the case of implementation of these processes and implementation of other activities on the territory of one constituent entity of the Russian Federation.

4. Legal entities and individuals, including individual entrepreneurs (hereinafter referred to as applicants), in order to approve the construction and reconstruction of capital construction projects, introduce new technological processes and carry out other activities, submit an application for approval to the Federal Fishery Agency (its territorial bodies) ( hereinafter referred to as the application), which contains the following information:

a) about the applicant:

full and abbreviated (if any) name of the legal entity, its organizational and legal form and location;

last name, first name, patronymic and place of residence of an individual (individual entrepreneur);

b) about the documentation attached to the application.

5. The following documentation is attached to the application:

a) when approving the construction and reconstruction of capital construction projects in accordance with these Rules - a copy of the sections of the design documentation provided for in paragraphs 10, 12, 17, 18, 22-25 (for capital construction projects for production and non-production purposes, with the exception of linear objects) and paragraphs 34-40 (for linear objects) of the Regulations on the composition of sections of project documentation and requirements for their content, approved by Decree of the Government of the Russian Federation of February 16, 2008 No. 87;

b) when agreeing on the introduction of new technological processes and the implementation of other activities in accordance with these Rules - a copy of the project documentation or program of planned work justifying the introduction of new technological processes and the implementation of other activities, as well as a document containing information on planned measures for the conservation of aquatic biological resources and their habitat.

6. The application and the accompanying documentation specified in these Rules (hereinafter referred to as documentation) are submitted by the applicant to the Federal Fisheries Agency (its territorial bodies) directly or sent by mail with a description of the attachment or in the form of an electronic document signed with an enhanced qualified electronic signature , using public information and telecommunication networks, including the federal state information system "Unified portal of state and municipal services (functions)".

The form of the application sent electronically and the procedure for its submission are established by the Ministry of Agriculture of the Russian Federation.

7. The application and documentation received by the Federal Fisheries Agency (its territorial bodies) are registered on the day of their receipt.

8. The Federal Fisheries Agency (its territorial bodies) reviews the application and documentation and makes a decision on approval (or refusal to approve) the construction and reconstruction of capital construction projects, the introduction of new technological processes and the implementation of other activities (hereinafter referred to as activities) on time, not exceeding 30 calendar days from the date of receipt by the Federal Fisheries Agency (its territorial bodies) of the application and documentation.

9. The decision to approve (refuse to approve) an activity is drawn up in the form of a conclusion, which is signed by the head or authorized deputy head of the Federal Fisheries Agency (its territorial body) and contains the following information:

a) a brief description of the activity and characteristics of its impact on aquatic biological resources and their habitat;

b) measures for the conservation of aquatic biological resources and their habitats, planned in accordance with the documentation;

c) conditions and restrictions necessary to prevent or reduce the negative impact of activities on aquatic biological resources and their habitat (conditions for water intake and wastewater disposal, conditions for work in water protection and fisheries protection zones, coastal protective strip of a water body and fisheries conservation area, restrictions on the timing and methods of carrying out work in the water area and other conditions);

d) conclusions about the admissibility of the impact of activities on the state of aquatic biological resources and their habitat;

e) decision on approval (or refusal to approve) the implementation of activities;

10. The decision to approve (refuse to approve) the implementation of the activity is communicated to the applicant in the form in which the application and documentation were submitted (by mail or in the form of an electronic document signed with an enhanced qualified electronic signature of an authorized official of the Federal Fisheries Agency (its territorial body).

11. The decision of the Federal Fisheries Agency (its territorial body) to refuse approval for the implementation of activities must contain the grounds for the refusal.

12. The grounds for refusal to approve the implementation of activities are:

a) submission of incomplete documentation to the Federal Fishery Agency (its territorial bodies);

b) non-compliance of documentation with the requirements of the legislation on fishing and the conservation of aquatic biological resources, water legislation, as well as legislation in the field of environmental protection on the conservation of aquatic biological resources and their habitat.

13. In case of refusal to approve the activity, applicants may re-submit the application and documentation to the Federal Fisheries Agency (its territorial bodies) provided that the documentation is finalized taking into account the comments and recommendations provided for in the decision to refuse approval to carry out the activity.
