Sometimes these are successful projects of successful companies, which at one point become unpromising and abandoned. “Opalikha O3” is an impressive project, one of the “cities for living” that the Urban Group created according to the European model. It was supposed to become a vast block with beautiful and bright residential buildings, infrastructure facilities, a pine forest outside the fence and its own exit onto the Novorizhskoye Highway. Some of this really exists - a pine forest, a road, and even some buildings. But the unexpected bankruptcy of the developer froze the project for a long time and brought it to naught, or changed beyond recognition the good intentions and creative ideas laid down at the beginning of the project.

The saddest thing about this whole situation is the people. They have to wait for years for apartments, fix deficiencies on their own, live without infrastructure, endure the indifference and incompetence of managers and management companies, achieve what they paid for a long time ago and what is rightfully theirs. And what they get today with great difficulty does not look at all as impressive as it did in advertising renderings at the beginning of construction.

All this marketing happiness exists, as it were, separately from reality: after all, today “Urban Group” has gone into oblivion, and the current developer is trying his best to fulfill obligations to thousands of shareholders left without housing.

Location and transport situation



The residential complex is located in the Opalikha microdistrict of Krasnogorsk near Moscow. The area is green, picturesque, just a stone's throw from the buildings to the pine forest. 500 meters away is a lake with sandy beaches suitable for swimming.
True, several industrial zones are located not so far away, including a machine-building plant and a weaving factory.

Currently, the residential complex does not have its own infrastructure: the kindergarten and school are not completed, the rest exists only on paper. There are no shops or social facilities nearby.

Formally, without traffic jams, you can get to the center of the capital by car in half an hour, to the Moscow Ring Road - in 5 minutes, to the Third Transport Ring - in 20. The Volokolamskoye Highway lies 4 kilometers away, however, during rush hours it is very seriously loaded.

The complex has its own exit onto Novorizhskoye Highway, however, there are problems with it. The fact is that this road is not registered in any way, after the completion of the first buildings they began to issue passes for it - as many as five per apartment. People began to resell them, and if not chaos, then some confusion reigned on the road. The fact is that residents of Krasnogorsk began to avoid traffic jams along it, and the promised convenience for residents noticeably decreased.

For those who travel to public transport, it is most convenient to use electric trains - they regularly depart from the Opalikha railway station, and it is located within walking distance. The nearest metro station “Tushinskaya” is 13 kilometers away; you can get to it by bus or minibus.

What and why went wrong

According to the initial documentation, the first stage of the Opalikha O3 residential complex was supposed to be commissioned at the end of 2016. Along with the buildings, they promised to build a school and a kindergarten. However, the deadlines were delayed, although the construction of houses continued.

The first alarm bells began back in 2017: workers were not paid wages, the speed of work dropped noticeably. In February 2018, the last house was commissioned - the construction of 7 more buildings came to a complete standstill. There was no parking, the kindergarten was in its infancy, and the residents stopped even dreaming about a school.


People who finally received their apartments and moved into them immediately began to experience a lot of problems. The elevators didn't work. The basements were flooded. Problems with communications began - endless leaks and accidents. Workers lived in the concierge rooms - they were not paid, and some simply had nowhere to go (some of them opened apartments in unfinished buildings and lived there). In reviews, residents wrote that radiators and heat exchangers were stolen from their entrances. There were also serious problems with the finishing - double-glazed windows with cracks, grout in the bathroom of the wrong colors, missing baseboards, broken sockets.

12/11/2018 The Arbitration Court recognized the ownership of an apartment in the Opalikha O3 residential complex at the address: Krasnogorsk, st. Prishvina, building 6 (we remind you that you do not need to wait for the suspension and then the refusal of Rosreestr).

12/10/2018 recognized the right of ownership from judge Vasilyeva Yu.O. for the storage room in building 6 of the Opalikha O3 residential complex (for a share).

05.12.2018 recognized the right of ownership from Judge Gubin Y.Yu. for a parking space in the Opalikha O3 residential complex (per share).

04.12.2018 The Arbitration Court recognized the ownership of an apartment in the Opalikha O3 residential complex at the address: Krasnogorsk, st. Prishvina, house 9.

November 14, 2018 Judge Vasilyeva (Krasnogorsk court) recognized the ownership of a parking space (share) in a parking lot for 306 spaces in the Opalikha O3 residential complex.

November 12, 2018 Three decisions were made regarding the Highgate developer in the Krasnogorsk court. All pantry decisions and all for the benefit of our customers. Judge Gubin has houses 7 and 15, Judge Belova has houses 7.

08.11.2018 recognized the ownership of the storage room in the Krasnogorsk court (judge Kaverina), in the cases of two of our clients from the Opalikha O3 residential complex in building 17 (for a share).

07.11.2018 In the Arbitration Court of the Moscow Region, Judge Kozlova ruled in favor of our client - the ownership of the apartment in the Opalikha O3 residential complex at the address: Krasnogorsk, st. Prishvina, house 2.

October 22, 2018 Judge Palagina from the Krasnogorsk court ruled in favor of our client regarding a parking space in the Opalikha O3 residential complex (they recognized ownership of the unfinished construction site).

10/17/2018 Judge Belova from the Krasnogorsk court ruled to satisfy our client’s claim for recognition of ownership of the storage room in the second house on Prishvina Street.
The claim was filed on September 10, 2018, i.e. Our lawyers received a decision in almost a month that will help the shareholder to easily register property rights in Rosrestr.

10/16/2018 In the Arbitration Court of the Moscow Region, our lawyers received from Judge Kozlova the following positive decisions on recognition of ownership of apartments in the Opalikha O3 residential complex at the addresses:
- Krasnogorsk, st. Prishvina, house 4;
- Krasnogorsk, st. Prishvina, house 9 (two decisions for different plaintiffs);

On October 15, 2018, in the Krasnogorsk court, our lawyers received five positive decisions on the recognition of ownership of non-residential premises in the Opalikha O3 residential complex.
Judge Kaverina made two decisions regarding storage rooms in houses 4 and 9 on the street. Prishvina. Both storage rooms on cadastral registration in houses put into operation. After receiving the decision, you can register ownership.
Judge Vasilyeva made three decisions (on recognizing ownership of a share in an unfinished construction project) on objects that were not put into operation:
- for the storage room in building 7;
- two parking spaces in the underground parking for 306 m/spaces.
Please note that all five claims were filed in August 2018, i.e. after the date of introduction of bankruptcy proceedings against the developer.

10.10.2018 In the Arbitration Court of the Moscow Region, Judge Kozlova satisfied our client’s claim for recognition of ownership of an apartment in the Opalikha O3 residential complex.
The plot of the case: the apartment was transferred under a deed, the shareholder submits documents to the MFC to register ownership and receives a notice of suspension state registration.
The registrar specifies the following reasons as grounds for suspension:
- a power of attorney was not provided under which the developer’s representative signed the acceptance certificate for the transfer of the apartment;
- the powers of the person who signed the share participation agreement have been terminated;
- the registrar has doubts that the documents submitted for registration are authentic;
- registration of ownership of a property after the introduction of bankruptcy proceedings against the developer may entail a violation of the rights and legitimate interests of third parties.
The matter has reached a dead end. It is useless to appeal the actions of the registrar, because The registrar operates in strict accordance with 218-FZ "On State Registration of Real Estate".
The only correct way out of the situation is recognition of ownership of the apartment in the Arbitration Court.

10/08/2018 Judge Gubin from the Krasnogorsk court satisfied the claims of two of our clients in the Opalikha O3 residential complex for recognition of ownership of storage rooms in houses put into operation at the addresses:
- st. Prishvina, house 2;
- st. Prishvina, house 6.
Both storage rooms are registered in the cadastral register; ownership rights can be registered in Rosreestr based on a court decision.

09/27/2018 Judge Zotova from the Krasnogorsk court satisfied our client’s claims for recognition of ownership of the storage room in the house put into operation at the postal address: st. Prishvina, house. 1, building 1. The storage room is registered in the cadastral register; the substation can be registered in Rosreestr.

09/27/2018 Judge Kaverina from the Krasnogorsk court satisfied our client’s claims for recognition of ownership of a storage room in a house put into operation at the postal address: st. Prishvina, house. 2. The storage room is registered in the cadastral register, which gives the shareholder the opportunity to register ownership in Rosreestr based on a court decision.

09/18/2018 Judge Anikeeva from the Krasnogorsk court satisfied our client’s claims for recognition of ownership of a share in an unfinished construction project for two parking spaces in the Opalikha O3 residential complex.

09/13/2018 Judge Gubin from the Krasnogorsk court satisfied our client’s claims for recognition of ownership of a share in the unfinished construction of a parking lot (underground two-story parking for 306 cars) in the Opalikha O3 residential complex.

08/28/2018 Judge Kaverina from the Krasnogorsk court satisfied our client’s claims for recognition of ownership of a share in an unfinished construction project for a storage room in building 14 of the Opalikha O3 residential complex.

October 21, 2018 The deadline for submitting applications has expired (three months from the date of publication in Kommersant about the introduction of bankruptcy proceedings against Urban developers). If you missed the deadline, we will restore it in court!

Please note that the bankruptcy trustee’s lawyers are not coming to the court hearing in the Krasnogorsk court yet, but this will not continue forever. The bankruptcy trustee’s interest is understandable in including more non-residential premises in the bankruptcy estate, for which shareholders will not have time to recognize ownership in the courts. When KU lawyers start going to court and putting a spoke in the wheels of shareholders, a lawyer’s work will be both more difficult and more expensive.

Letter from the initiative group of the Opalikha O3 residential complex in connection with the replacement of bricks with tiles in buildings 16 and 17

The problem that worries shareholders is that the developer, perhaps for the sake of saving money, decided to replace the tiles planned for use for finishing facades. One part of the shareholders believes that the tiles will begin to fall off after the warranty period and they need to file a claim in court. Another part of the shareholders believes that such actions will lead to delays in the construction of buildings 16 and 17, which is much more important than what type of tiles the facades will be finished with. We, the undersigned, and the developer have entered into agreements on participation in shared construction(hereinafter referred to as the Agreement) Multi-apartment residential buildings 16 and 17 (hereinafter referred to as MRR No16, No17) in residential complex“Opalikha O3” (hereinafter – LCD O3).
According to Project declarations on Moscow Railways No. 16, No. 17 dated 05/02/2017, as well as Construction Permits NoRU50-10-3353-2015 dated 12/22/2015 on Moscow Railways No. 17 and No. RU50-10-5845-2016 dated 08/24/2016 ( instead of the previously issued No. RU50-10-2651-2015 dated November 12, 2015) on the Moscow Railway No. 16, issued by the Ministry of Construction Complex of the Moscow Region, the construction of the Moscow Railway No. 16, No. 17 is carried out according to Project documentation which received a positive Conclusion non-state examination LLC "ExpertStroyEngineering" No4-1-1-0066-15 dated November 3, 2015 for Moscow Railways No. 17, No. 4-1-1-0062-15 dated October 27, 2015 and No. 50-2-1-2- 0021-16 dated February 19, 2016 (adjustment) for Moscow Railways No. 16 (hereinafter referred to as the Expertise Conclusions).

According to clause 2.7.3. “Constructive solutions”, Expert conclusions on the Moscow Railway No. 17, the external walls of the Moscow Railway No. 17 above the ground level are designed of the following types:
- Type I: 400 mm thick masonry made of aerated concrete blocks, 80 mm thick mineral wool insulation, cladding with decorative material;

- Type III: monolithic reinforced concrete 200 mm thick, liners made of Primaflex 35 type insulation 50 mm thick, masonry 150 mm thick from aerated concrete blocks, mineral wool slabs 80 mm thick, cladding with decorative material;

According to clause 3.3 “Structural solutions”, Examination conclusions (adjustment) for Moscow Railway No. 16, the external walls of Moscow Railway No. 16 above the ground level are designed of the following types: - Type I: 400 mm thick masonry made of aerated concrete blocks, 80 mm thick mineral wool insulation, cladding with decorative material;
- Type II: monolithic reinforced concrete 200 mm thick, slabs of the Primaflex 35 type 50 mm thick, masonry 150 mm thick from aerated concrete blocks, mineral wool slabs 80 mm thick, cladding with decorative material;

The decorative finishing layer for the external walls of Moscow Railways No. 16 and No. 17 is provided in three types:
- SFRC panel (glass fiber reinforced concrete);
- Decorative plaster;
- Clinker tiles.

Also in the subsection “During the examination” of paragraph 2.7.3. “Constructive solutions” of the Expertise Conclusion on Moscow Railway No. 17 and paragraph 3.3 “Constructive Solutions” of the Expertise Conclusion (adjustment) on Moscow Railway No. 16 states:
When constructing a facility, the customer and contract construction organizations are required to use only certified construction products and equipment.
The use of materials, including finishing materials, structures, products and equipment without the appropriate certificates is unacceptable.
