After another crash Russian ruble 2014-2015 mortgage borrowers who took a loan in foreign currency faced the need to pay huge amounts to the bank. And not at all those on which they counted, concluding a loan agreement. Once in financial bondage, they turned to the state for help.

At first, officials of all stripes convinced disgruntled citizens that the sharply increased debt was a consequence of their greed and hindsight. But then the statesmen nevertheless developed an assistance program mortgage borrowers. True, not for all debtors affected by a significant fall in the national currency.

The assistance program has been running since 2015. However, those wishing to solve their financial difficulties at the expense of the state turned out to be so much that allocated for the project budget resources ended, and he himself was curtailed.

But at the end of the summer of 2017, the state decided to extend the program. On August 11, 2017, government decree No. 961 was issued on further measures to support mortgage lenders in a difficult financial situation. Some changes have been made to the existing program. From its content, it became clear that the state was completely oriented towards supporting the unlucky foreign exchange debtors.

The new program has a number of features:

  1. Assistance to citizens with unsustainable mortgage debt is provided through its restructuring. This means that the loan is not "forgiven", but the bank renegotiates with the client new treaty loan, with more favorable terms for the borrower. Or draws up an additional agreement to the old one. The main purpose of the drawn up documents is to reduce the financial burden on the debtor, to make the loan agreement enforceable.
  2. No more than 30% of the mortgage debt is compensated at the state expense. At the same time, the maximum possible amount that can be allocated for partial repayment of the loan is 1.5 million rubles.
  3. The state warns that the assistance is provided one-time, and in further risky transactions with the bank, citizens will have to rely solely on themselves.

When paying off part of the debt through the assistance program, the bank is obliged to restructure the loan on certain conditions:

  1. Re-register foreign currency loans in rubles - at the rate in force at the time of the conclusion of the renewed agreement;
  2. Set the interest rate for the borrower no more than 11.5% (annual);
  3. “Forgive” the client a certain amount of debt - at least 1.5 million rubles (due to partial write-off and / or recalculation at a more favorable exchange rate);
  4. Do not charge the debtor for late payments a penalty (with the exception of amounts collected by a court decision and fines paid earlier);
  5. Don't cut deadlines credit obligations debtor.

On behalf of the state, assistance to mortgage borrowers is provided by AHML. This is the short name of the “Agency for Housing Mortgage Lending”, through which banks receive funds in the amounts of lost income from the client. That is, by urging creditors to meet the debtors, the state from the treasury covers their costs arising from the mitigation of the terms of the mortgage agreement (within the established limits). 2 billion rubles were transferred to the Agency's account for these purposes.

Pay attention: the maximum possible amount of compensation may be increased, but not more than twice its amount. The decision on this is made by a special interdepartmental commission - at the request of the debtor.

Currently, the AHML official website contains information that mortgage debt restructuring is possible in 2 types:

  1. Reducing the interest rate;
  2. Recalculation in ruble equivalent at a lower rate.

Who can count on support

The government dictates tough conditions for those who are going to participate in it. The August government decree significantly reduced the list of citizens to whom the state is ready to cover part of the debt. For example, earlier it included employees of defense enterprises, municipal employees, and scientists. They are not on the new list.

In 2019, the assistance program applies only to the following categories of borrowers:

  1. Adult citizens with disabilities;
  2. Parents raising children with disabilities;
  3. Veterans who participated in armed conflicts of recent decades (combat operations);
  4. Parents / guardians / guardians of minor children (in any number);
  5. Parents who provide financial support for their children, who study full-time in various educational institutions - until the “children” reach the age of 24.

This list is closed, that is, exhaustive. However, strict requirements are imposed not only on debtors, but also on real estate, which is purchased with money borrowed from the bank.

Real estate requirements

The assistance program applies to certain residential properties.

They have to:

  1. be located in Russia;
  2. Be the only housing of the borrower and his household (it is allowed for them to have a share in another apartment/house/room, but not more than 50%);
  3. Do not exceed specified dimensions total area premises:
  • 85 m2 - for a 3-room (or more) residential facility;
  • 65 m2 - for a 2-room residential facility;
  • 45 m2 - if a property with 1 living room is taken in a mortgage.

Interestingly, in the past current program great attention was paid to the cost square meter housing purchased with a mortgage. It should not exceed the average market for the region by more than 60%. And the maximum footage was set not by the number of rooms, but by the number of family members of the pledgor living in mortgage apartment. However, the updated assistance program from AHML does not contain these restrictions.

Requirements for borrowers

In order to participate in the program, borrowers must not only be included in the above list of “preferential” categories, but also meet very important additional criteria:

  1. 3 months before submitting an application to the bank for mortgage restructuring, average income each member of the borrower's family, after paying the planned amount on the loan, did not exceed two subsistence levels established in the region of their residence. Thus, the emphasis is on families with low and medium incomes, in which, despite the regularity of income, a mortgage loan has become an unbearable burden.
  2. At the time of application for restructuring, regular loan payments must increase by at least 30% - compared to the amounts that were planned to be paid to the bank on the day the loan agreement was concluded. This condition cut off ruble-denominated mortgage lenders, who may also be experiencing difficult financial problems, from the program. However, such a giant leap in monthly installments likely only if the mortgage was taken in foreign currency.

Required documents

It will include:

  1. Photocopies of papers proving both the identity of the borrower himself and all his household members: Russian passports, "children's" certificates;
  2. Documents that confirm that he belongs to one of the categories of Russians who have the right to repay a mortgage with the help of the state:
    • certificates for children (if it is their presence that gives the right to state support);
    • veteran's certificate prescribed form;
    • certificate of MSEC on the presence of disability - for himself or for his child;
    • paper from an educational institution confirming the fact that a son or daughter is studying full-time, etc.;
  3. Documents evidencing the amount of income of the borrower or solidary debtors, as well as the total income of members of his family - for the last 3 months:
    • photocopies of the pages of the work book;
    • certificates taken at work 2-NDFL;
    • certificate of receipt of unemployment benefits (for able-bodied, but unemployed citizens);
    • extract from the Pension Fund of the Russian Federation on the amount of pension for Last year(for pensioners / disabled people or when receiving benefits for a disabled child);
    • an extract on the amount of "custodial" payments, etc.;
  4. A valid mortgage agreement concluded with the creditor bank (it must be executed at least a year before applying for debt restructuring);
  5. Monthly payment schedule - to repay the target loan;
  6. Form No. 9 (provided in passport office at the place of registration);
  7. An application of the established form, in which the borrower informs about his own property status and his family members, concerns whether they have other real estate (its form can be downloaded and viewed on the AHML official website).

And even such a long list is likely to be incomplete, since different banks participating in the state mortgage subsidy program set their own list of required documentation. Usually it is posted on the electronic portals of credit organizations.

Pay attention: an extract from the USRN on the ownership of the borrower (s) on the subject of collateral, that is, on real estate purchased on credit, banks no longer require applicants. Previously, they had to be taken, but now AHML itself requests this document in Rosreestr.

Assistance Scheme

So, a borrower experiencing difficulties in repaying a loan needs to contact the lender bank and find out if the lender is participating in this state program.

If the answer is positive, the debtor will have to take a number of actions in order to receive assistance from AHML:

  1. You need to find out which department of the bank deals with this issue. Usually this is the department for dealing with debtors (or with overdue debts). By phone or through the website you need to find out his location and contact details.
  2. By calling the department or arriving in person, the borrower specifies what documents he will have to collect for submission to the bank.
  3. Having collected necessary papers, the citizen sends them to the financial institution along with the application form. It states the reason why the borrower is applying for public assistance.
  4. Having received a package of papers from the debtor, financial institution sends them to AHML for verification. It is believed that on average it lasts about a month. However, it is better to tune in to a longer wait, as many citizens complain that they had to wait for an answer for six months.
  5. Often AHML requests additional documents which the applicant must provide.
  6. If the Agency makes a positive decision, the bank informs the debtor about it and sets a meeting time to draw up a new loan agreement.
  7. At the meeting, either a completely new contract with modified conditions is drawn up, or an additional agreement is drawn up to the current document. An adjusted schedule of regular payments is also developed and signed, a paper is issued on changing the content of the mortgage.
  8. The previous mortgage is requested from the bank's archive. She has to wait 2-4 weeks.
  9. Then all amended, supplemented and newly drawn up documents are submitted for registration. On this, the procedure can be considered completed.

A new program of assistance to mortgage borrowers for 2015-2017 has been approved - mortgage holders will receive up to 600 thousand rubles and restructuring of foreign currency mortgages at the Central Bank rate.

The mortgage assistance program has been extended until May 31, 2017 inclusive. However, since March 7, the program was closed ahead of schedule due to the spending of the allocated funds. Those who managed to apply can count on restructuring.

Prime Minister Dmitry Medvedev approved new program state assistance to mortgage borrowers who experience problems with mortgage payments (ruble or foreign currency). Maximum amount assistance is 1.5 million rubles (previously this amount was 200 thousand rubles, and later 600 thousand rubles).

The following can count on assistance from the state in repaying a mortgage:

  • citizens with one or more minor children;
  • citizens who are guardians (custodians) of one or more minor children;
  • citizens raising children with disabilities;
  • since 2017: citizens who are dependent on adults under the age of 24 who are full-time students;
  • combat veterans.

This category of citizens will be provided with financial assistance from the Agency for Housing Mortgage Lending (AHML) for one mortgage loan in the amount of up to 600 thousand rubles, but not more than 20% (previously, in 2016 10%) of the balance of the principal debt. From February 23, 2017: the amount of assistance has been increased to 1.5 million rubles, but not more than 30% of the balance of the principal debt, but only for:

  • combat veterans;
  • citizens who have two or more minor children;
  • citizens who are guardians (custodians) of two or more minor children;
  • citizens with one minor child and who are guardians (custodians) of one minor child;
  • citizens who are disabled or have disabled children.
  • citizens with one minor child;
  • citizens who are guardians (custodians) of one minor child;
  • citizens with one minor child; for citizens who are dependent on adults under the age of 24 who are full-time students;

the amount of assistance remains the same - 600 thousand rubles, but not more than 20% of the balance of the principal debt.

Money will not be handed out, assistance will consist in converting a foreign currency mortgage at a rate not higher than the rate of the Bank of Russia or writing off part of the principal debt, or reducing the amount of the monthly assistance payment for up to 18 months.

Foreign currency mortgage holders will be able to convert a foreign currency mortgage into a ruble mortgage at the rate of the Bank of Russia without commissions or reduce the monthly payment by up to 50% for up to 18 months. After the restructuring, the interest rate will not exceed 12% per annum.

If the amount of the payment is reduced to 50% for a period of 18 months, the amount of savings on payments cannot exceed 1.5 million rubles and be more than 30% (previously, in 2016 10%, later in 2017 - 20%) of the balance of the principal debt as of the date restructuring requests.

How to get help paying off your mortgage

The borrower needs to apply to the bank (creditor) with applications for restructuring, and it is not necessary to have an overdue loan debt, but at least 12 months must pass from the moment of registration of the mortgage to the submission of the application .

Any mortgage can be restructured, including those issued under other social programs.

Income Requirements

Average monthly family income for 3 months prior to application after deduction average monthly payment on a mortgage for the same period does not exceed two living wages for each family member (borrower and co-borrowers).

However, the average monthly household income for the 3 months prior to application must be at least 30% lower than the average monthly income for same period before the date of conclusion of the mortgage agreement (requirement expired in 2017).

In the case of a foreign currency mortgage, the amount of the monthly payment for the last 3 months prior to the date of submission of the application for restructuring must be at least 30% higher than the amount of the payment on the date of conclusion of the contract. After paying such a payment, the remaining amount of income of the borrower and his family members (husband/wife, minor children) should not be more than two living wages in the region of residence for each (requirement expired in 2017).

Housing Requirements

The property purchased with a mortgage must be the only dwelling and belongs to the category of economy class housing, and its area should not be more than:

  • one-room apartment - 45 sq.m;
  • two-room apartment - 65 sq.m;
  • three-room and more - 85 sq.m.

According to the Decree of the Government, creditors (including banks) have the right to independently form a list of documents, on the basis of which a decision will be made on the provision of state assistance to borrowers. List of documents for restructuring of AHML is exemplary.

Recall that, at the suggestion of the Ministry of Construction, the state program for mortgage restructuring has been extended until May 31, 2017. Also, a number of changes were made to the program, including an increase in the amount of assistance to mortgage holders.

What can the bank do?

Mortgage loan is issued in accordance with the norms federal law“On Mortgage (Pledge of Real Estate)” (hereinafter referred to as the Law). In the past few years, borrowers who have issued a mortgage in foreign currency have found themselves in the most difficult situation. Due to the fact that the ruble has fallen sharply by more than two times, for many borrowers, the amount of monthly payments has become unbearable. The return of money under the state mortgage program is carried out by all categories of borrowers, regardless of the currency in which the loan was issued.

What is the Federal Mortgage Borrower Assistance Program?

In 2015, the state program of assistance to mortgage borrowers was adopted. The result was the signing of the Decree of the Government of the Russian Federation "On the main conditions for the implementation of the assistance program certain categories borrowers on mortgage housing loans (loans) who find themselves in a difficult financial situation, and an increase authorized capital joint-stock company“Agency for Housing Mortgage Lending” No. 373 (hereinafter referred to as the Resolution). In order to help mortgagors, the statutory fund of the Agency for Housing Mortgage Lending was increased by 4.5 billion rubles at the state expense. The deadline for the state mortgage assistance program has been extended several times and ends on May 31, 2017.

Who is provided with state assistance to write off the principal debt on a mortgage?

In 2017, not all categories of mortgage lenders can take advantage of assistance to mortgage borrowers who find themselves in a difficult life situation. To apply for a government subsidy for a mortgage, you need to meet a number of requirements. If at least one requirement is not met, the borrower arranges restructuring in accordance with federal program can not.

At the same time, mortgage repayments provided by the state should not exceed 20% of the amount of the remaining debt, but at the same time it maximum size should not exceed 600,000 rubles. The rest of the amount the mortgagee must pay out of his own pocket.

Category of the mortgage borrower

Real estate area

The ordinance also limits the size of the total area of ​​the immovable advantage. For an apartment consisting of one room, the total area should not be 45 m2, two rooms - 65 m2, three rooms - 85 m2.

The requirement to limit the area and price per square meter of real estate does not apply to borrowers who have three or more children.

Number of residential properties

In 2017, only those mortgage borrowers for whom this property is their only home. It is allowed that the borrower and his family members own part of the residential property, but not more than 50%.

How to get help from the state to pay off mortgage debt?

Most mortgage lenders are interested in the question: how to receive compensation for a mortgage from the state? To do this, the borrower must go to the banking institution that issued the loan to him and write an application where he sets out a request to restructure the remaining amount.

Federal assistance can be provided in one of the following forms:

  • if the mortgage was received in foreign currency, it can be recalculated into the national one at the exchange rate on the day of signing the restructuring;
  • for a mortgage that was issued in rubles, the rate may be set, which should not exceed the rate in force at the time of signing the restructuring agreement. If the mortgage was issued in dollars or euros, then size limit should not exceed 12%;
  • reduction in amount monthly payment 50% for up to 18 months. The disadvantage of this option is that the term of the contract increases and, accordingly, the overpayment of mortgage interest increases;
  • transfer of the remaining amount of the mortgage into the national currency at a lower rate than the one that was established central bank at the time of conclusion of the restructuring agreement;
  • one-time forgiveness of a certain amount.

Who offers a mortgage loan restructuring service?

Almost all banking organizations offering mortgage loan services have joined the assistance program adopted by the state. A complete list of them can be found on the official website of the Agency for Housing Mortgage Lending.

Borrowers need to note that the program only applies to the loan itself and interest on it. With regard to penalties for late payments, the bank has the right to refuse to write off or reduce them. For this reason, it is better not to delay contacting the bank, using the program as early as possible.

The program does not apply to penalties or fines provided by the bank for late payments.

How to get restructuring for other categories of borrowers?

Since the requirements for mortgage lenders covered by the state program are quite strict, many borrowers simply cannot use it. At the same time, the number of people who find themselves in a difficult situation and do not have the financial ability to pay on a loan is huge.

It should be remembered that it is unprofitable for the bank to immediately start a lawsuit. Litigation can take years, and sometimes (albeit rarely) decisions are not in favor of the financial institution. That is why banking organization it is more profitable to resolve the issue amicably, with the least losses for each of the parties.

For this reason, in the event of a difficult financial situation, it is advisable for the borrower not to delay in writing to the bank with a request for debt restructuring. The client may be offered one of the following restructuring methods:

  • extension of the term of the mortgage agreement. This allows you to reduce the amount of monthly payments, but increases the amount of overpayment on interest;
  • if the difficult financial situation is temporary, then the bank can offer credit holidays for a certain period, most often for several months. During the holidays, the borrower is required to pay only the interest rate;
  • penalty cancellation. Most banks for late payment or making it not in in full provide huge fines. For the client, the financial institution can cancel the penalty;
  • recalculation of debt from foreign exchange into the domestic one. Most often, the conversion is made at the rate in force at the time of signing the contract, but sometimes the bank may offer the client a lower exchange rate.

The federal program is aimed at helping the most vulnerable categories of mortgage lenders, for whom a housing loan was the only way to solve housing issue. The State Program for Assistance to Mortgage Borrowers with a valid loan experiencing financial difficulties was developed at the level of the federal power structure and is being implemented through restructuring current debt on housing loans.

Decree

The main conditions of the Resolution under consideration are:

  1. A special interdepartmental commission has been set up to consider applications and make competent decisions on compensation for creditors' losses.
  2. You can use state support only once (this requirement is strictly monitored by authorized bodies).
  3. The right to make a decision on the advisability of restructuring the mortgage belongs to the creditor bank, which accepts a corresponding application from the client.
  4. The restructuring process can be carried out both by changing the terms/parameters of the concluded loan agreement through an additional agreement, and by drawing up a new loan agreement or amicable agreement between the parties.
  5. The maximum amount of potential compensation cannot exceed 30% of the outstanding amount owed to credit institution(in monetary terms, no more than 1.5 million rubles will be reimbursed).

By decision of the Government of the Russian Federation, the deadline for the implementation of the assistance program has been extended. An expiration date has not yet been set.

What help can be provided

It is important to understand that needy borrowers are not completely exempted from making monthly loan payments and from paying insurance premiums for property or personal insurance. However, a number of options have been developed to provide effective assistance in housing lending which will help alleviate the situation.

Among the types of such assistance in 2019:

  • replacement of the loan currency (relevant for clients who issued a loan before the end of 2014 in foreign currency);
  • lowering the current credit rate(it cannot be higher than the value effective on the date of conclusion of the restructuring agreement for ruble loans and higher than 11.5% for foreign currency loans);
  • reduction of residual debt to the bank by 30%, but not more than 1.5 million rubles;
  • writing off accrued forfeits, penalties and fines that have already been paid by the client by court order.

IMPORTANT! Which option of assistance will be applied will depend on the nuances of the current situation in the life of the borrower. Each application is considered individually.

Program duration

The project of assistance to mortgage borrowers under the adopted Decree of the Government resumed its operation on August 22, 2017. For these purposes, from state budget more than 2 billion rubles were allocated.

The government has not set a specific end date for the program. However, it is not difficult to guess that it will cease to operate when the funds run out.

The project was periodically suspended, then continued its work on the restructuring of problematic mortgages.

Program conditions

Not every loan is subject to restructuring. The borrower himself, the loan and mortgaged property must comply with fairly stringent requirements and restrictions. Let's consider them in more detail.

Who can become a member

Only Russian citizens of certain categories can count on assistance from the state in relation to a valid mortgage loan. These categories include:

  1. Disabled persons or persons with disabled children.
  2. Families or citizens with one or more minor children (this also includes legal guardians).
  3. Parents with children under the age of 24 due to the latter's full-time education in secondary, secondary specialized and higher educational institutions of various profiles.
  4. Combat veterans.

For foreign currency borrowers, the key condition is an increase in the current monthly loan payment by at least 30% at the time of application in comparison with the date of conclusion of the loan agreement.

Real estate requirements

The subject of the mortgage, by analogy with the borrower, must meet certain requirements. Among them:

  • restriction on the total area of ​​real estate: for 1-room. apartments - no more than 45 m 2, for 2-room. apartments - no more than 65 m 2 and for 3-room. apartments - no more than 85 m 2;
  • the pledged property under the loan agreement is the only housing of the borrower;
  • the property is pledged by the bank for at least 1 year.

With regard to the single housing factor, the assistance program allows the ownership of the total share of the borrower, together with his spouse and minor children (if any) per room and not more than 50%.

How to participate in the program

In order to take advantage of the AHML Mortgage Assistance Program, a borrower should apply to an existing lender and mortgagee with a self-filled and signed application requesting loan restructuring. You should contact credit department or to the department for work with overdue debts.

Then the application, together with the set of all papers attached to it, will be sent directly to AHML for consideration and a final decision on the advisability of providing support with the participation of the state. The list of required documents includes:

  • copies of passports of all participants in the transaction (borrower and members of his family, co-borrower, guarantors, pledgee);
  • a document confirming that a person is classified as a privileged category (for example, a certificate of disability, a veteran's certificate, a child's birth certificate, a decision of the guardianship authorities to establish guardianship, a certificate of family composition, etc.);
  • a document confirming the level of solvency (income) of the borrower for at least the last 3 months before the date of consideration of the submitted application (a copy of the work book, GPA, certificate 2-NDFL, certificate in the form of a bank, certificate from the Pension Fund of the Russian Federation are attached, Bank statements etc.);
  • a copy of the loan agreement with the payment schedule attached to it;
  • documents for collateral (DDU, contract of sale, cadastral passport, certificate of ownership, etc.).

Main issues and problems of program implementation

Like any other state program, the project of assistance to borrowers with valid mortgage loan has its own problems and implementation features. The following points are noted:

  1. program in her latest edition is focused mainly on foreign currency borrowers, for whom the credit burden after 2014 has become prohibitive.
  2. Practice proves high percent refusal by AHML to borrowers who apply for financial assistance, indicating the grounds for receiving it “the presence of dependent children”.
  3. Due to the volume of the required package of documents, their collection may take more than one week, which delays the consideration of the application and the adoption of a decision.
  4. The mechanism for providing support to families with four or more children has not been worked out (AHML and banks refer to the possibility of using regional programs this category of citizens in the form of subsidies).
  5. Partner banks are not interested in the program and delay the provision of assistance.
  6. Periodic breaks in the implementation of the project to support borrowers with mortgages due to the expenditure of funds allocated from the budget.
