Government Russian Federation decides:

1. Approve the attached changes that are being made to the basic conditions for the implementation of the assistance program for certain categories of borrowers for housing mortgage loans (loans) who find themselves in a difficult financial situation, approved by Resolution No. 373 of April 20, 2015 “On the basic conditions for the implementation of the assistance program for certain categories borrowers under mortgage housing loans (loans) who find themselves in a difficult financial situation, and an increase authorized capital Joint Stock Company "Housing Mortgage Lending Agency" (Collected Legislation of the Russian Federation, 2015, No. 17, Art. 2567; No. 50, Art. 7179; 2016, No. 50, Art. 7089; 2017, No. 8, Art. 1245).

2. To the Ministry of Construction and Housing and Communal Services of the Russian Federation:

before September 1, 2017, create an interdepartmental commission to make decisions on compensation to creditors (lenders) for mortgage housing loans (loans), mortgage agents operating in accordance with the Federal Law "On Mortgage securities", for residential mortgage loans (loans), the rights of claim for which were acquired by mortgage agents, and the joint-stock company "House Mortgage Lending Agency" for mortgage housing loans (loans), the rights of claim for which were acquired by this company, losses (parts thereof) incurred as a result of the restructuring of housing mortgage loans (loans) in accordance with the terms of the assistance program for certain categories of borrowers for housing mortgage loans (loans) who find themselves in a difficult financial situation, approve the regulations on the said commission, the composition and procedure for its work;

send to the joint stock company "Housing Mortgage Lending Agency" in the prescribed manner funds in the amount of 2 billion rubles in accordance with the order of the Government of the Russian Federation dated July 25, 2017 N 1579-r as a contribution to the authorized capital of the joint stock company "Housing Mortgage Lending Agency" " for the purpose of compensation for losses (part of them) to creditors (lenders) for residential mortgage loans (loans), mortgage agents operating in accordance with the Federal Law “On Mortgage Securities”, for residential mortgage loans (loans), the rights of claim for which acquired by mortgage agents, and the joint stock company "Housing Mortgage Lending Agency" for residential mortgage loans (loans), the rights of claim for which were acquired by this company, in the event that these mortgage housing loans (loans) are restructured in accordance with the terms of the assistance program for certain categories of borrowers for residential mortgage loans (loans) that find themselves in a difficult financial situation.

3. Federal Agency for Management state property ensure, in accordance with the established procedure, an increase in the authorized capital of the joint stock company "Housing Mortgage Lending Agency" by 2 billion rubles by placing additional shares and carry out actions related to the acquisition of these shares and registration of ownership of the Russian Federation, in accordance with the tripartite agreement between the Ministry of Construction and Housing and Communal Services of the Russian Federation, Federal agency for the management of state property and the joint-stock company "Agency for Housing Mortgage Lending".

4. To recommend to the joint stock company "Housing Mortgage Lending Agency" before increasing the authorized capital in accordance with paragraph three of paragraph 2 and paragraph 3 of this resolution to direct its own funds in the amount of no more than 500 million rubles to reimburse creditors (lenders) for residential mortgage loans ( loans), mortgage agents operating in accordance with the Federal Law "On Mortgage Securities", for residential mortgage loans (loans), the rights of claim for which were acquired by mortgage agents, losses (parts thereof) arising as a result of restructuring under the terms of the program assistance to certain categories of borrowers for housing mortgage loans (loans) who find themselves in a difficult financial situation, and to allow the funds received in accordance with paragraph three of paragraph 2 of this resolution to be used to reimburse the costs of the joint-stock company "Housing Mortgage Lending Agency" incurred during the implementation of the assistance program certain categories of borrowers for housing mortgage loans (loans) who find themselves in a difficult financial situation, in accordance with this paragraph.

5. If borrowers’ applications for restructuring of housing mortgage loans (loans) were received before the entry into force of this resolution, but were not satisfied, compensation for losses (part thereof) to creditors (lenders) for housing mortgage loans (loans), mortgage agents carrying out activities in accordance with the Federal Law "On Mortgage Securities", for housing mortgage loans (loans), the rights of claim for which were acquired by mortgage agents, and the joint-stock company "House Mortgage Lending Agency" for housing mortgage loans (loans), the rights of claim for which acquired by this company, can be carried out in the event of a repeated application by the borrower, subject to compliance with the basic conditions for the implementation of the program of assistance to certain categories of borrowers for residential mortgage loans (loans) who find themselves in a difficult financial situation, as amended by this resolution.

1. The main conditions for the implementation of the program of assistance to certain categories of borrowers for housing mortgage loans (loans) who find themselves in a difficult financial situation (hereinafter referred to as the program) determine the conditions for the restructuring of housing mortgage loans (loans) for certain categories of borrowers who find themselves in a difficult financial situation, and also the conditions for compensation to creditors (lenders) for residential mortgage loans (loans), mortgage agents operating in accordance with the Federal Law “On Mortgage Securities”, for residential mortgage loans (loans), the rights of claim for which were acquired by mortgage agents, and joint stock to the company "Housing Mortgage Lending Agency" for residential mortgage loans (loans), the rights of claim for which were acquired by this company, losses (parts thereof) arising as a result of such restructuring (hereinafter referred to as lender, borrower, compensation, restructuring, respectively).

2. Reimbursement under the program is made one-time for residential mortgage loans (loans) restructured in accordance with this document, in the manner established by the joint-stock company "Housing Mortgage Lending Agency", published on its official website on the Internet.

3. Losses (part thereof) of the creditor for each mortgage housing loan (loan) restructured in accordance with this document are subject to compensation in the amount by which, as a result of restructuring in the cases provided for in subparagraph "c" of paragraph 10 of this document, the amount is reduced monetary obligations borrower under a credit agreement (loan agreement), but no more limit amount compensation, established by paragraph 6 taking into account paragraph 7 of this document.

4. Reimbursement under the program is carried out within Money provided for the implementation of the program.

5. Restructuring is carried out on the basis of the creditor’s decision on the application for restructuring submitted by the borrower to the creditor (hereinafter referred to as the application for restructuring).

Restructuring can be carried out by concluding an agreement between the creditor and the borrower (joint and several debtors) to change the terms of a previously concluded loan agreement(loan agreement), concluding a new loan agreement (loan agreement) for the purpose of full repayment of debt on a restructured mortgage loan (loan), concluding a settlement agreement (hereinafter referred to as the restructuring agreement). The terms of the restructuring agreement must comply with the requirements established by paragraph 10 of this document.

6. The maximum amount of compensation for each restructured mortgage housing loan (loan) is 30 percent of the balance of the loan (loan) calculated as of the date of conclusion of the restructuring agreement, but not more than 1,500 thousand rubles, except for the cases provided for in paragraph 7 of this document.

7. In accordance with the decision of the interdepartmental commission for making decisions on compensation to creditors (lenders) for residential mortgage loans (loans), mortgage agents operating in accordance with the Federal Law “On Mortgage Securities” for residential mortgage loans (loans), the rights of claim for which were acquired by mortgage agents, and the joint stock company "House Mortgage Lending Agency" for housing mortgage loans (loans), the rights of claim for which were acquired by this company, losses (part of them) arising as a result of the restructuring of housing mortgage loans (loans) in in accordance with the terms of the program (hereinafter - interdepartmental commission), the maximum amount of compensation for each restructured mortgage housing loan (loan) based on the corresponding application of the creditor to the interdepartmental commission can be increased, but not more than 2 times, in the manner prescribed by the regulations on the interdepartmental commission.

8. Unless otherwise provided by this document, as of the date of filing the restructuring application, the following conditions must be simultaneously met:

a) the borrower (joint and several debtors) is a citizen of the Russian Federation belonging to one of the following categories:

citizens who have one or more minor children or are guardians (trustees) of one or more minor children;

citizens who are disabled or have disabled children;

citizens who are combat veterans;

citizens who are dependent on persons under the age of 24 who are students, students (cadets), graduate students, adjuncts, residents, assistant trainees, interns and full-time students;

b) change in the financial position of the borrower (joint and several debtors) - monthly average total income family of the borrower (joint and several debtors), calculated for 3 months preceding the date of filing the application for restructuring, after deducting the amount of the planned monthly payment for a credit (loan) calculated on the date preceding the date of filing the application for restructuring, does not exceed for each family member of the borrower (joint and several debtor) twice the minimum subsistence level established in the constituent entities of the Russian Federation in whose territory the persons whose income was taken into account in the calculation live . At the same time, the average monthly total income of the family of the borrower (joint and several debtors) in billing period equal to the sum of the average monthly income of the borrower (joint and several debtors) and his family members, which for the purposes of this subclause include the spouse of the borrower (joint and several debtor) and his minor children, including those under his guardianship or trusteeship, as well as persons indicated in paragraph five of subparagraph "a" of this paragraph, and the amount of the planned monthly payment on the loan (loan), calculated on the date preceding the date of filing the application for restructuring, increased by at least 30 percent compared to the amount of the planned monthly payment, calculated on the date concluding a credit agreement (loan agreement);

c) security for the fulfillment of the borrower’s obligations under a credit agreement (loan agreement) is a mortgage of a residential premises located on the territory of the Russian Federation, or a pledge of rights of claim to such residential premises arising from an agreement for participation in shared construction, meeting the requirements Federal Law"On participation in shared construction apartment buildings and other real estate and on making changes to some legislative acts Russian Federation" (hereinafter referred to as the agreement for participation in shared construction);

G) total area residential premises, including residential premises, the right of claim to which arises from an agreement for participation in shared construction, the mortgage of which is security for the fulfillment of the borrower’s obligations under the credit agreement (loan agreement), does not exceed 45 sq. meters - for a room with 1 living room, 65 sq. meters - for a room with 2 living rooms, 85 sq. meters - for a room with 3 or more living rooms;

e) residential premises, including residential premises, the right of claim to which arises from an agreement for participation in shared construction, the mortgage of which is security for the fulfillment of the borrower’s obligations under the credit agreement (loan agreement), is (will be) the only housing of the mortgagor. At the same time, in the period starting from the date of entry into force of the Decree of the Government of the Russian Federation of April 20, 2015 N 373 “On the main conditions for the implementation of the program of assistance to certain categories of borrowers for housing mortgage loans (loans) who find themselves in a difficult financial situation, and an increase in the authorized capital of the joint stock company "Agency for Mortgage housing lending"by the date the borrower submits an application for restructuring, it is allowed to have a total share of the mortgagor and his family members in the ownership of no more than 1 other residential premises in the amount of no more than 50 percent. For the purposes of this subclause, family members of the mortgagor include the spouse of the mortgagor and his minor children, including those under his guardianship or trusteeship. Compliance with these conditions is confirmed by the borrower’s application in simple written form. Submission by the borrower of information from the Unified state register no real estate required. Joint-Stock Company The Housing Mortgage Lending Agency checks the information provided by the borrower in accordance with this subparagraph;

f) the credit agreement (loan agreement) was concluded at least 12 months before the date the borrower submitted an application for restructuring, except for cases where the mortgage loan (loan) was provided for the purpose of full repayment of debt on a housing mortgage loan (loan) provided at least than 12 months before the date the borrower submits the restructuring application.

9. In case of non-compliance with no more than two conditions provided for in paragraph 8 of this document, payment of compensation under the program is allowed in accordance with the decision of the interdepartmental commission in the manner prescribed by the regulations on the interdepartmental commission.

10. The restructuring agreement must simultaneously provide for the following conditions:

a) changing the currency of the loan (loan) from foreign currency to Russian rubles at a rate not higher than the rate of the corresponding currency established Central Bank of the Russian Federation as of the date of conclusion of the restructuring agreement (for loans (loans) denominated in foreign currency);

b) establishing the lending rate not higher than 11.5 percent per annum (for credits (loans) denominated in foreign currency) or not higher than the rate in force on the date of concluding the restructuring agreement (for credits (loans) denominated in Russian rubles);

c) reduction of the monetary obligations of the borrower (joint and several debtors) in the amount of not less than the maximum amount of compensation established by paragraph 6 taking into account paragraph 7 of this document, due to a one-time forgiveness of part of the credit (loan) amount and (or) changing the currency of the credit (loan) from a foreign one currencies for Russian rubles at a rate lower than the rate of the corresponding currency established by the Central Bank of the Russian Federation on the date of conclusion of the restructuring agreement (for credits (loans) denominated in foreign currency);

d) exemption of the borrower (joint and several debtors) from paying the penalty accrued under the terms of the credit agreement (loan agreement), with the exception of the penalty actually paid by the borrower (joint and several debtors) and (or) collected on the basis of a court decision that has entered into legal force.

11. When concluding a restructuring agreement, it is not allowed to reduce the terms of mortgage housing loans (loans) and (or) charge the creditor from the borrower (joint and several debtors) of a commission for actions related to the restructuring.

12. All payments under the program are carried out in Russian rubles at the rate of the corresponding currency established by the Central Bank of the Russian Federation on the date of conclusion of the restructuring agreement (for credits (loans) denominated in foreign currency).

Mortgage loans, as one of the few available ways getting your own living space are quite popular banking service. The essence of the program and latest news

The purpose of the bill is to restructure the “problematic” mortgage loan, the maintenance of which becomes an unbearable obligation for an individual. The borrower can make changes to a previously signed agreement or enter into a new one, which results in a reduction in the rate, a change in the loan currency to rubles, and an exemption from paying fines.

The state program in force for 2019 is an extension of the previous Decree of the Government and State Duma of the Russian Federation dated April 20, 2015 No. 373. The updated terms of co-financing are regulated by Law No. 961 of August 11, 2017, which came into force on August 22, 2017. The main changes affected the amount of funds that can be written off at the expense of the state.

Important! If the borrower has previously submitted an application for debt restructuring before the latest provision of legislation came into force, but it was not accepted, the individual has the right to re-submit the papers for consideration.

In 2017, the state aid project provided for compensation in the amount of 20 percent of the actual amount of debt, but not more than 600 thousand rubles. After the latest amendments came into force, the conditions became different:

  • A fixed interest rate is established, not exceeding the value on the date of registration of the restructuring papers.
  • The amount of actual debt is reduced by 1.5 million, but according to the terms, the debt can be repaid at the expense of the state by a maximum of 30 percent.
  • Obligations to pay penalties, penalties or other fines that accrued during the validity of the mortgage agreement are removed. Refunds of amounts already paid are not provided.
  • The rate for foreign currency loans is set at up to 11.5% per annum, for ruble loans - less than the rate applied at the time of signing the restructuring documents.

If initially borrowed funds were received in foreign currency, it will be changed to rubles at a rate not exceeding the current one. When signing an agreement on loan restructuring, a banking institution does not have the right to demand payment of additional fees for actions taken and to reduce the payment period.

For today, help in case of emergency financial problems with the repayment of mortgage debt is provided by the Agency for Housing Mortgage Lending JSC. The same organization will compensate for losses incurred by credit institutions when part of the debt is closed.

Important! An approved application for participation in the state assistance program does not give the right to pay insurance payments at the expense of allocated funds (including title and personal insurance).

Conditions of participation in the state program and requirements

The state support program is not available to all citizens, but only to those who find themselves in difficult life situations. All categories are designated in the Resolution dated August 11, 2017. However, by decision of the interdepartmental commission, the conditions can be revised, but within clearly defined limits.

Important! In accordance with paragraph 7 of Resolution No. 961, by decision of the interdepartmental commission, the amount to be reimbursed can be revised and increased at the request of the creditor bank, but not more than twice. Also, this governing body is able to approve an application from an individual if he does not meet one or two points of the requirements.

In order to become a participant in the program, you must simultaneously meet all the conditions and requirements specified in the law. Their general list looks like this:

  1. requirements for borrowers;
  2. requirements for the mortgaged property;
  3. criteria of the loan agreement;
  4. conditions of the borrower's financial condition;
  5. requirements for your own real estate.

The conditions for obtaining restructuring are specified in paragraph 8 of Resolution No. 961. Moreover, it is established that the borrower must meet all criteria, with the exception of the permitted deviation of 2 points, which will be analyzed by an interdepartmental commission.

Who can apply for government support?

The following categories of the population can take advantage of financial support for mortgages from AHML:

  • Parents or legal guardians with children under the age of majority.
  • Persons with disabilities and parents of disabled children.
  • Citizens who took part in hostilities.
  • Persons whose guardianship includes dependents under 24 years of age (students, students, graduate students, interns, interns, etc.) studying full-time.
  • At the same time, there are a number of conditions and financial condition client:
  • Decrease monthly income by no less than 30%.
  • The total average monthly earnings of the borrower and other members of his family for at least 3 months should not exceed the subsistence minimum in double the amount for each person (monthly mortgage payments are taken into account).

Requirements for a mortgage agreement

Not every “problem” loan can be restructured. The state has established special requirements and conditions in this regard:

  1. Increase in the monthly payment amount by 30% or more. The first payment and the last one, which was made before submitting the application, are subject to comparison.
  2. The lending bank must be a participant in the assistance program.
  3. The original mortgage must be at least a year old at the time you apply for assistance. Exceptions are cases when a loan was taken out to repay housing loan received more than 12 months before the date of drawing up the restructuring document.
  4. Providing the bank with an application and a complete package of documents.

Paying attention to paragraph 1, we can conclude that for the most part the restructuring program is aimed at foreign currency mortgages. It is under such agreements that it is quite expected that the payment increased by a third or more, since the US dollar, in the period from 2014 to 2019, almost doubled in price. This also follows from the order of restructuring, where, among simultaneous changes loan agreement indicated “currency change to rubles.” However, this condition is not directly stated, that is, if the mortgage is in rubles (including the refinancing of a foreign currency mortgage into rubles), it makes sense to submit an application.

In other cases, as a rule, mortgage agreements imply a fixed or decreasing payment and a single interest rate for the entire payment period, which does not meet the requirements. The contribution amount may be changed due to debt restructuring without adjusting the term, variable rate or other factors.

Important! Overall size credit debt, including delays, and previous participation in the restructuring of the contract do not matter. The client interacts with AHML through an intermediary acting as an agent bank to which the initial application is submitted.

What kind of mortgage can be restructured?

Russian legislation has established certain criteria that property acquired at the expense of credit funds. These include the following:

  • This living space must be the only one owned by an individual and all members of his family (it is assumed that the borrower and another person from his family have a total share of less than 50% in other real estate).
  • Purchased property in mandatory must be located in one of the localities of the Russian Federation and serve as collateral for the mortgage.
  • The program applies to all types of living space, including those purchased under a contract equity participation.
  • Criteria for the object itself real estate: studio apartment in apartment building– up to 45 sq. m., if there are two living rooms - up to 65 sq. m., if the room has three or more rooms - up to 85 sq. m. m.
  • Price per 1 sq. m. of the collateral object should not exceed average cost similar apartment or house on the primary or secondary residential real estate market is more than 60% (for calculations, data from Rosstat of Russia and information are used regional market). The listed restrictions do not apply to large families (three or more children).

How to restructure debt: procedure

The entire procedure related to changes in conditions is carried out in several stages. The first involves visiting a financial institution in person and drawing up an official application. The borrower must contact the branch of the bank where the original loan agreement was concluded. Using the sample provided by the manager, you need to write a statement about the need for debt restructuring.

You can prepare it first at home. All necessary documentation is attached to it. After this, the borrower, together with the bank employee, discusses the new lending conditions.

Important! Restructuring of an existing mortgage loan is carried out according to a decision made by the creditor bank to which the client submitted an application.

All papers are carefully studied, and it is also checked whether all requirements and restrictions under the assistance program are met. After a certain time, the borrower will be notified by the credit committee of the decision. It should be noted that banks have the authority to independently set the minimum and maximum terms for considering an application and making a final verdict. As a rule, this should take about 30 days, but judging by the reviews, we can talk about more long term, since banking institutions and AHML often require you to provide additional documents. The final third stage involves new agreement, already with different conditions, or an additional agreement to the previous one is drawn up.

When these three stages are completed, the borrower needs to contact the Ministry of Justice with the old mortgage and a ready-made package of papers in order to register changes to the collateral agreement.

What documents are needed for registration?

To consider an application to revise the terms of the contract, mortgagers need to prepare in advance and attach a package of documentation (it can be found on the official AHML website), consisting of the following:

  • Identity cards of all participants in the transaction and family members (passports) and copies thereof.
  • Documents confirming that the borrower falls into one of the preferential categories of individuals applying for financing (children’s birth certificates, combat veteran’s certificate, VTEK certificate/medical and social examination (copy), etc.).
  • Documents confirming the amount of earnings of all participants in the transaction for at least 3 last month(photocopies of the work book, certificate of earnings according to the 2-NDFL model or other official documents). Unemployed citizens also attach their employment certificate, a certificate of the amount and nature of accrued benefits, and information about the status of their account with the Pension Fund.
  • An extract obtained from the state register, which confirms the status of the pledge. Applications indicating the existing real estate owned by the borrower and his family or its absence (the application form can be downloaded).
  • Mortgage papers and all documents related to the mortgage (purchase and sale agreement and its copy, property appraisal report, mortgage payment schedule, cadastral and technical passport).
  • Agreement on shared participation in construction and its copy (if available).

The borrower will also be required to fill out an application form and consent to the processing of personal information. The forms of these papers depend on the specific bank.

In addition to the listed documents, each financial institution or AHML itself may require additional papers to be attached, depending on the situation, which will help make the right decision on the application for loan restructuring.

Assistance from the state is mainly aimed at supporting the most needy citizens of the Russian Federation, for whom the financial burden becomes unbearable. What is the federal mortgage assistance program?

The Government of the Russian Federation has approved a program to help borrowers who previously took out a mortgage on their home. Citizens who found themselves in difficult financial situations could claim some privileges.

People who managed to submit documents under this program before March 7 have the right to count on assistance from the state for mortgage holders.

The specificity of the program was that citizens could receive the amount of 600 thousand rubles. The documents had to be submitted to the AHML.

Since 2017, a new resolution has been approved regarding the restructuring of mortgages of citizens in difficult financial situations.

Mortgage restructuring

The Government of the Russian Federation established the operation of the program by Resolution No. 961 of the Russian Federation dated August 11, 2017.

The maximum amount of compensation for each restructured mortgage loan is equal to 30% of the balance, but not more than 1,500 thousand rubles.

By refinancing, the loan rate is reduced and payment in installments is provided.
