This is where the most painful question arises: where to get the money to complete the project?

But this is, so to speak, the finish line of a protracted marathon. Let's go back to 2009 and remember whose fault it was that ordinary construction fell into the category of problems on a regional scale.

MGKUP "Invest-System"— that was the name of the organization that signed agreements with shareholders and pledged to put the house into operation by February 28, 2010. People had no reason not to trust their developer or doubt his professionalism, because the founder of this enterprise was the Mogilev City Executive Committee. It would seem, what other guarantees are needed? However, the facts turned out to be stronger than the recommendations: neither by the above date, nor by June 30, 2010, nor by December 30, 2010, nor by June 30, 2011, nor by December 30, 2011, the object was ready. By September 1, 2011, they completely disappeared from the construction site.

— It’s very simple: the developer approached the start of construction completely unprepared. During the regulatory period, that is, from March 2009 to February 2010, Invest-System entered into agreements with only 27 shareholders out of 92. The currency crisis put an end to this financial leapfrog - there was clearly not enough money for our house, the gap was significant. Therefore, on August 8, 2011, the Mogilev City Executive Committee decided to merge Invest-System with MGKUP "Management" capital construction" with the transfer of the rights and obligations of the developer to the latter. Simply put, Invest-System was taken out of the game and all its debts were assigned to the UKS, subordinate to the executive committee.

So, let us remember: the developer, who owed his appearance to the Mogilev City Executive Committee, received a plot of land in the very center of the city and grossly violated the terms of the concluded agreement. Left people without completed apartments. And after that it ceased to exist by decision of the city administration. Curious, isn't it? But does the list of complaints against Invest-System end there? As it turns out, no.

Riddles of the "pyramid"

Unscheduled inspection of the regional control department of the Ministry of Finance on certain issues of financial and economic activity MGUP "Invest-System", which examined the period from January 1, 2009 to December 19, 2011, revealed a whole layer of violations. In the near future, employees of the Mogilev Department of Economic Crimes will give a legal assessment of these facts, and as a result, a decision will be made to initiate a criminal case. In the meantime, we can voice some obvious episodes that shed light on how “effectively” Invest-System built its houses...

— This organization systematically violated the norms of current legislation. In particular, the resolution of the Council of Ministers and the National Bank clearly stipulating the attraction of funds from shareholders only to special accounts of the developer. As well as their subsequent use intended purpose. Simply put, Invest-System built its facilities according to the “pyramid” principle, diverting funds from shareholders to finance work not provided for project documentation,” Olga Shepelevich, deputy head of the Main Directorate of the Ministry of Finance for the Mogilev Region, leafs through the inspection report. — For example, misuse of funds for the house on the street. In the course of its activities, Invest-System repeatedly violated Resolution of the Council of Ministers No. 1207 on the procedure for returning money to shareholders who withdrew from shared construction. As is known, funds must be returned to them taking into account the index of changes in the cost of construction and installation work. On the other hand, the contribution of an investor newly entering into construction is calculated as a share of the indexed cost of work performed and other costs on the date of entry. But in practice, everything turned out differently: for some reason, all new shareholders who signed contracts instead of those who left were not presented with the indexed price per square meter for payment. For those who left, on the contrary, the funds were returned to in full, as it should be.

“Thus, the company unnecessarily increased its costs by 227 million 632 thousand rubles,” states Olga Shepelevich. — Three-section house on the street. Chekhov suffered more than 91 million rubles in this regard. Now UKS will have to compensate for these financial shortcomings of its predecessor.

This is the kind of developer who has warmed up under the wing of the Mogilev city authorities. I wonder who controlled the activities of this enterprise and how? And what conclusions can be drawn today regarding the quality of this control?

"Our comments went unheeded..."

...But we digress. How do events develop further? On March 21 and 28, in the Mogilev City Executive Committee, by order of Governor Pyotr Rudnik, two meetings of the so-called conciliation commission were held, in which shareholders, as well as representatives of the management of the UKS, city and regional executive committees, took part. In fact, the main objective of these meetings - to approve the new calculated cost per square meter and the procedure for recognizing meters "bought" by shareholders. Alas, the stated agreement between the parties was never reached. Let's hear why shareholders dubbed these meetings a "forced commission."

— Each of us was given an “Approximate calculation of the paid volumes of work performed.” But a detailed acquaintance with this document showed: the UKS is trying to artificially increase the cost of construction and, at our expense, compensate for losses associated with untimely construction and the use of funds received earlier. In the new additional agreement, we are asked to postpone the commissioning of the house to June 2012 (on January 26, by decision of the Mogilev Regional Executive Committee, the construction period has already been extended until June of this year inclusive. - Author). At the same time, the UKS flatly refuses to include in the text of the additional agreement the phrase that the regulatory construction period expired in February 2010. What does it mean? And the fact is that by signing this document, we automatically “include” new indices in the calculation of the cost per meter changes in construction and installation work and relieve the successor developer from liability for months and years of delay.

Of course, UKS is completely happy with this. But Presidential Decree No. 396 clearly states: after regulatory period indexes for later dates are not applied, say Alexey Linev, Andrey Bodunov, Vitaly Tatarinovich, Dmitry Kubar and other shareholders of the house on Chekhov Street. — As a result, without finishing, the cost per square meter that the developer offered us doubled: for those in need - up to 5 million 252 thousand rubles (initially it was 2 million 350 thousand rubles). For those not in need - up to 6 million 373 thousand rubles (previously 2 million 780 thousand rubles). Fundamental comments for us regarding price formation were left unheeded. On March 28, a meeting of the second conciliation commission decided: the UKU should prepare letters to shareholders and offer to sign new additional agreements within a week. Otherwise, contracts with us will be terminated unilaterally.

How did the shareholders get out of the critical situation? We signed additional agreements, but with a protocol of disagreements. Moreover, each of them in writing demanded that UKS justify the cost of 1 sq. m. m total area at base prices of 1991. And also give a calculation of the cost of the house on the date of conclusion of the contract, indicating the applied indices. Why all this, you ask?

To make sure that the developer does not index base price March 2009 twice (shareholders directly indicate that in the proposed calculations it changed from 958.3 to 1129 rubles. But why?). The notification signed by the chief engineer of the UKS Alexander Shvayunov, which the shareholders received on April 10, left no chance of ever finding out this secret: “The UKS regards your protocol of disagreements as the shareholder’s disagreement with the proposed change in the price of the shared construction project and notifies you of early termination agreement... shared construction..." The chief engineer of the UKS in his letter calls the demands of the shareholders to answer the questions posed unlawful, since "this is not provided for either by Decree 396 or by the agreement."

The shareholders, of course, immediately responded with objections and the same awkward questions. But the UKS remained silent and waited, apparently realizing that people had little choice: either sign a new version of the agreement - or receive depreciated dollar equivalent amounts. Well, the calculation turned out to be correct: fearing inevitable termination, 67 out of 92 shareholders signed additional agreements. Some of them still continue to resist.

Let's sum up the intermediate results. So, UKS, to which, by decision of the Mogilev City Executive Committee, all the obligations of Invest-System were transferred, set a new cost per square meter (“approximate, average and indicative”) and does not want to give explanations on issues that are significant for shareholders. We emphasize financial matters, affecting the interests of families being built with state support. Construction time for a house on the street. The Chekhov region successfully extended it until June 2012 inclusive. The majority of shareholders signed additional agreements under circumstances known to us. It turns out that victory is for UKS? Formally, yes. But let's face it: this victory has a very bad look on its face.

14.3 billion rubles are missing for a house

I spent a lot of time talking with the chief engineer of the Mogilev UKS, Alexander Shvayunov, and his supervisor, the deputy chairman of the Mogilev City Executive Committee, Alexander Studnev. With one voice, they assure that the procedure for changing the construction schedule has been fully complied with, as has the postponement of the commissioning date of the facility. And the calculation of the new price per square meter was made on the basis of current legislation and verified. But I was never able to get clear answers to questions important to shareholders. Here they are.

Whose fault - the shareholders or the developer - is that they are starting to build a residential building with an unvacated private development spot and 27 shareholders out of 92? Does the developer, in light of Presidential Decree No. 396, have the right to apply construction and installation work change indices for new dates outside the standard construction period, which leads to a significant increase in the cost of the project? Can the fact that in the certificates for October 2011, Invest-System provided information about the readiness of the facility being 41.5 percent be considered a deliberate distortion of information? And at the beginning of February 2012, after continuous construction, the UKS announced 20.42 percent? Finally, what should those shareholders do in whose accounts tens of millions of rubles have been depreciating over the years? credit funds, which the developer did not use at one time, but is recalculating today, based on the new estimated price? That is, it does not take this money into account as previously purchased meters.

In our opinion, the answers to many of these questions lie in the minutes of the meeting of conciliation commission No. 1. So, attention: the estimated need for the completion of the construction of a three-section residential building on the street. Chekhov - more than 27.3 billion rubles. Taking into account the fact that the developer plans to receive 13 billion rubles from shareholders, the deficit of funds is about 14.3 billion rubles. Is this where the urgent desire of individuals to raise the price bar as high as possible stems from? Another thing is interesting: where will UKS get this money and who will subsequently repay such an impressive debt?

— We take a budget repayable loan under the guarantees of the city executive committee. The city will provide us with part of the funds on behalf of the governor as part of co-financing,” said Alexander Shvayunov. — How are we going to repay? I won’t tell you the exact mechanism now. I think we’ll finish building the house and sort out this issue.

At the beginning of April, the size of this loan, according to Alexander Studnev, was 3 billion rubles.

The new additional agreement contains an important clause stating that the final price of the facility is calculated upon completion of construction. This means only one thing: even the current cost per square meter is a variable value, like the spring wind. Alas, no force will prevent the developer from raising it in July, say, to 7, 8 or even 9 million rubles. The main thing is to complete the house before July 1, thereby fulfilling the governor’s instructions, and then... The practice of signing additional agreements in the UKS, as we have seen, has been worked out well. Apparently, no complaints or obstacles are expected from the city and region.

"We are outraged..."

...There is another obscure point in this story. Having failed to obtain the truth from city officials and UKS specialists, shareholders twice made their way to a personal meeting with Governor Pyotr Rudnik. And the last two times they were forced to watch him in the morning at the entrance to the executive committee: alas, they simply have no other opportunity to get an appointment with the first person of the region and convey their disagreement.

— We are outraged by the unprecedented position of the head of the department for working with citizens’ appeals and legal entities Regional Executive Committee Nikolai Osipenko. In this situation, he is on the side of the Mogilev City Executive Committee, which condones and justifies the unlawful actions of the UKS. He refuses to make an appointment with us, so we are forced to stand guard outside the regional executive committee and wait until the governor gets out of the car,” the shareholders do not hide their indignation. “The last time we gave our appeal was on the morning of April 17 after the UKS threatened to terminate the contract early. We hope that Pyotr Mikhailovich will once again understand this situation in detail and help us defend our case in the unequal struggle with city officials and the UKS. After all, we are not slaves who can be ignored and coerced. And, believe me, they are not billionaires at all, at the expense of whom you can “hide” other people’s financial mistakes from regulatory authorities.

The governor’s reaction was not long in coming: on April 30, another meeting of the conciliation commission was held, headed by the deputy chairman of the regional executive committee, Anatoly Cherny. Nine of the most active benefit shareholders were invited to attend.

— Once again, we insisted that the calculation of “bought meters” be carried out taking into account the ones we opened credit lines. The point is that all these years the bank gave the developer money (just take it and build it), but neither Invest-System nor then UKS were able to use it. Because of this, shareholders-beneficiaries now find themselves in a more losing situation with this calculation method than those who build apartments for own funds. If previously we needed to contribute from 5 to 25% of the cost of the apartment, now this figure has increased to 30-40% (taking into account the increase in the price of 1 sq. m to 5.25 million rubles, this amount is simply fabulous - 100 or more million rubles for a 3-room apartment). Where does such capital come from? large family? — Alexey Linev, Andrey Bodunov, Vitaly Tatarinovich, Valery Korotkevich, Larisa Gavrilina and other meeting participants ask themselves. — Apparently, agreeing with us, the deputy governor made a proposal: since there are no funds, we can consider a budget option in a panel house. In addition, the UKS was instructed to work on the issue of increasing the TPC coefficient (typical consumer qualities), which affects the share preferential loan in the price of the apartment. And also the exclusion from the cost of apartments for beneficiaries of compensation for demolition and relocation of residents whose houses fell into the “development stain”.

Time will tell whether these sensible proposals will end up on paper. In the meantime, beneficiaries are urgently seeking significant amounts of money and depositing them into the UKS account. After all, the developer threatens to use 2012 indices for late payments.

…I wonder if, after this publication, there will be empowered readers who, following the journalist “R,” will visit Mogilev? And will they stand up for those whom the shared construction roulette has unfairly placed in the losing “zero” sector? After all, these people no longer have time to defend themselves. And the price per square meter continues its difficult-to-predict “flight”.

With the decision of the Mogilev Regional Executive Committee No. 1-47 to extend the construction period of a three-section house on the street. Chekhov, as well as the notification of MGKUP "UKS" about the early termination of the contract with the shareholders, we went to the Ministry of Architecture and Construction of Belarus.

“The regional executive committee, by its decision, has the right to change the construction time frame, but for this it is necessary to strictly follow the procedure that is prescribed in Presidential Decree 396,” explains “R” Denis Vladyko, chief specialist of the Main Construction Directorate of the ministry. — In particular, if the developer is not at fault for failing to meet the deadlines specified in the contract, shareholders must be notified of the new deadline two months in advance and invited to sign additional agreements. If the developer is guilty of violating the deadlines, then this must be reflected in the decision of the regional executive committee. On the second question, the specialist gave the following explanations:

— The demands of shareholders to provide them with information regarding the procedure for determining the cost per square meter cannot be called unlawful. In accordance with part 3 of clause 8 of the Rules for concluding, executing and terminating a contract for the creation of a shared construction project (approved by Presidential Decree No. 396), the developer is obliged to notify the shareholder of a change in the contract price with a reasonable calculation of it no less than 10 days before the end of the next payment. changes. “Reasonable calculation” means that the shareholder is provided not just with a set of tables with arithmetic operations, but each figure used in the calculations is justified. If only one unreliable indicator is used in the calculations, then it is obvious that the entire calculation will be unreasonable.

Fifty members of the Mogilev owner's association "Nash Sputnik" believe that the developer - a municipal unitary subsidiary of the Capital Construction Management of the City of Mogilev (UCS) - illegally embezzled about 25.5 thousand rubles from shareholders.

In early March, about fifty of them turned to Prosecutor General Alexander Konyuk, Head of the Presidential Administration Natalya Kochanova and Chief Inspector for the Mogilev Region Gennady Lavrenkov with a request to conduct an inspection and give a legal assessment of the actions of the Criminal Code. In the appeal, the shareholders indicate that during the construction of their house, 25.44 square meters were unfinished. m, which, nevertheless, were paid by them at an average rate of one thousand rubles per square meter.

“People should get their money back for unfinished squares if there is a reduction in the cost of the project,” the chairman of the shareholders’ partnership told BelaPAN Stanislav Trukhanenko, noting that this return does not occur.

According to Trukhanenko, despite the developer’s obligation to coordinate changes with equity holders enshrined in the construction contract, nothing of the kind is being done.

“In fact, no one coordinates it, and all work that could affect the reduction in price is carried out arbitrarily without the consent of the shareholders,” said the chairman. He noted that the UKS refused to register the additional agreement to the contract proposed by the shareholders.

As Trukhanenko said, there is still no electricity in the house, although it was officially put into operation on January 31.

— The house was opened with a lot of violations and lack of all the necessary documentation for entry. For some reason, the commission responsible for this commissioning turned a blind eye to this,” noted the chairman of the partnership. According to him, everything Required documents for housing registration, the developer gave shareholders only March 9, thereby violating established by law timing of this procedure.

In addition, the chairman demonstrated two acts of acceptance of the house with the same number and signed by the same commission, but with a different list of planned work.

— The developer redid the act of putting the house into operation retroactively to January 31, 2017 to hide his arbitrariness. Those. the developer forged documents. “There are authorities that will sort it out if such facts exist,” the head of the construction department of the Mogilev City Executive Committee told BelaPAN Vladimir Dudarev, whose signature appears on both acceptance certificates. In turn, director of the KUDP “Management of capital construction of the city of Mogilev” Andrey Moskalev declined to comment.

Currently, the Mogilev prosecutor's office has sent a citizens' appeal to the Leninsky District Department of Internal Affairs to verify the information.

A residential building is being built in a block of existing residential buildings on Legendary Street in the village of Buynichi, Mogilev district. The site is limited to the north by residential buildings, to the south and west by the territory of the preschool institution “Nursery Garden No. 2”, to the east by an undeveloped green area and further by a residential building. A five-story apartment building with 40 apartments was designed using technology monolithic construction VST using permanent CSP formwork with load-bearing reinforced concrete internal and external walls. The residential building consists of two sections and has a rectangular plan, with a technical underground, a combined roof without an attic, with a parapet and internal drainage. In total, the building has 40 apartments with a total area of ​​2596.10 m2.
Contracts are concluded for the shared construction of 40 apartments located on different floors, including:
-10 two-room apartments with a total area of ​​60.98 sq. m. (according to the project);
-10 two-room apartments with a total area of ​​68.99 sq. m. (according to the project);
