Who is required to obtain an AGR?

An architectural and urban planning solution is issued to those who begin new construction or reconstruction of existing buildings.

The applicant may be the copyright holder land plot, including owner, tenant. In relation to the plots, state cadastral registration must be carried out and an urban planning plan for the land plot must be drawn up.

But at the same time, there are categories of objects for which coordination and approval are not required. Such objects include:

  • objects no more than 1500 sq.m., no more than 2 floors outside the Central Administrative District and outside the central main streets;
  • buildings recognized as objects cultural heritage;
  • construction of individual housing;
  • linear type objects - construction of bridges, overpasses, overpasses and other similar objects;
  • buildings and structures that, during reconstruction, up to restoration load-bearing structure will not lose anything in appearance.

It should be noted that the law on the introduction of AGR is a law only for the capital and annexed territories of New Moscow, this is a Moscow architectural law.   • Data on conclusions (approvals) previously obtained based on the results of reviewing the materials of the architectural and urban planning solution of the facility capital construction(at the initiative of the applicant);
  • Number of the urban planning plan of the land plot;
  • Characteristics of the architectural and urban planning solution of the facility (including information about the materials used; calculation of the required number of parking spaces)
  • Technical and economic indicators of the object (if there are several buildings, they must be indicated for the entire object as a whole, as well as for each building separately):
    • area of ​​the plot (sq.m);
    • building area (sq.m);
    • total area of ​​the building (sq.m);
    • ground area of ​​the building (sq.m);
    • underground area of ​​the building (sq.m);
    • area of ​​a residential building (for residential facilities) (sq.m);
    • number of floors (underground and above ground, including technical);
    • number of parking spaces;
    • number of surface guest parking lots.
  • The explanatory note must also contain technical and economic indicators that must be included in the materials of the architectural and urban planning solution for a capital construction project, taking into account the purpose of the object and if the following parameters are indicated in the urban planning plan of the land plot:
    • number of apartments, hotel rooms, offices (depending on the type of building), etc.;
    • total floor area in the dimensions of external walls (sq.m);
    • estimated ground area (sq.m);
    • percentage functions or indicators of the area of ​​the object, taking into account the functional purpose of the premises (%).

The normative (regulatory) period for approval of the AGR is:

  • 10 working days - for objects of regional significance;
  • 25 working days - for urban facilities.

Submission period public services is calculated after the request is registered with the ICA.

The “Certificate of Approval of Architectural and Urban Planning Solutions” must be registered with ISOGD.

The validity period of the Certificate is unlimited.

What constitutes an approval package?

After the draft Architectural and Urban Planning Solution has been developed, the documents are sent to the Committee on Architecture and Urban Planning. To form a package you need to prepare the following papers:

  • a written application to receive this public service;
  • passport and other document to confirm the identity of the applicant;
  • power of attorney for an authorized person, if the applicant does not apply for the service independently;

6. This resolution comes into force on July 1, 2013, with the exception of the provisions on monitoring the implementation of the approved architectural and urban planning solution for a capital construction project in accordance with the certificate of approval of the architectural and urban planning solution for a capital construction project when issuing a construction permit, in the time of construction work on capital construction projects, when putting capital construction projects into operation, which comes into force on September 1, 2013.

CAPITAL CONSTRUCTION OBJECTS IN MOSCOW

1. The Regulations on the approval of architectural and urban planning solutions for capital construction projects in the city of Moscow (hereinafter referred to as the Regulations) were developed in accordance with the Urban Planning Code of the City of Moscow, Federal law dated November 17, 1995 N 169-FZ "On architectural activities in Russian Federation", the order of the Moscow Mayor from "On the Architectural Council of the City of Moscow" and other regulatory legal acts of the Russian Federation and the city of Moscow in the field of architecture and urban planning.

2. Approval of architectural and urban planning solutions for capital construction projects in the city of Moscow is carried out taking into account the specifics of urban planning activities in the constituent entity of the Russian Federation - the federal city of Moscow and is aimed at achieving the following goals and objectives:

Formation and continuous development of the composition, silhouette and architectural and artistic appearance of the capital, preservation of cultural heritage, creation of a harmonious, landscaped and comfortable urban environment;

Optimization of administrative procedures in urban planning activities, ensuring a systematic approach when considering and approving architectural and urban planning solutions for capital construction projects in accordance with established evaluation criteria and requirements for materials of architectural and urban planning solutions;

Formation within information system providing urban planning activities (hereinafter referred to as ISOGD) with a database on adopted architectural and urban planning decisions for capital construction projects in the city of Moscow;

Improving the quality of architectural and urban planning solutions for capital construction projects.

3. The provision applies to capital construction projects (hereinafter referred to as objects), the architectural and urban planning solutions of which have been developed both within the framework of individual and standard projects(including reuse).

The provision does not apply to objects of cultural heritage and identified objects of cultural heritage, objects of individual housing construction, as well as linear objects(except for bridges, overpasses and overpasses).

4. The Regulations provide for the approval of architectural and urban planning solutions for objects in the city of Moscow when carrying out the following types of work:

a) construction;

b) reconstruction (except for reconstruction work related to the replacement and (or) restoration of load-bearing building structures of a capital construction project and not involving changes in the external appearance of the facility).

5. The formation of architectural and urban planning solutions for objects is carried out in accordance with the provisions of the legislation on urban planning activities and legal acts of the city of Moscow in the field of comprehensive landscaping of the territory.

6. The formation of architectural and urban planning solutions for objects located within the boundaries of the territories of cultural heritage sites and their protection zones is carried out in accordance with the legislation in the field of conservation, use, popularization and state protection objects of cultural heritage.

7. The formation of architectural and urban planning solutions for objects located within the boundaries of specially protected natural areas, natural and green areas is carried out in accordance with the legislation in the field of protection and use of these territories.

8. Approval of architectural and urban planning solutions for objects in the city of Moscow falls within the competence of the chief architect of the city of Moscow and is ensured (hereinafter referred to as the Committee).

9. The subject of assessing the architectural and urban planning solution of an object is its compliance functional purpose and the location of the object, taking into account the space-planning, compositional, silhouette, architectural, artistic, decorative, plastic, stylistic, coloristic characteristics of the object.

10. Consideration of the architectural and urban planning solution of the object is carried out taking into account the existing features and characteristics of the territory, including historical and cultural, visual and landscape, functional, planning, engineering and technical, architectural and urban planning, including compositional, typological, scale, stylistic, coloristic characteristics of the surrounding buildings.

11. A differentiated procedure for considering architectural and urban planning solutions for objects in the city of Moscow is provided, which are divided into objects of urban and district significance.

12. Differentiation of objects is carried out by the Committee in accordance with paragraphs 13, 14 of these Regulations, taking into account the location of the object in the city structure, city-forming role and social significance, features of the architectural and urban planning solution and technical and economic indicators of the object.

13. Objects of urban significance include objects characterized by one or more of the following characteristics:

b) located within the boundaries of the territories of cultural heritage sites and their protection zones;

c) located on main streets citywide (including on outbound highways and the Moscow Ring Road);

d) more than 10 floors high;

e) with an area of ​​more than 20 thousand square meters. m;

f) construction and (or) reconstruction of which is carried out at the expense of the budget of the city of Moscow;

g) especially dangerous, technically complex and unique.

14. Objects of district significance include objects not provided for in paragraph 13 of these Regulations.

15. Consideration of the architectural and urban planning solution for an object of urban significance is carried out by the Architectural Council of the City of Moscow and its commissions in the prescribed manner.

16. Consideration of the architectural and urban planning solution of an object of district significance is carried out by the structural divisions of the Committee in the manner established by the legal act of the Committee.

17. In order to comply with the requirements of legislation in the field of preservation, use, popularization and state protection of cultural heritage objects, materials for architectural and urban planning solutions for objects located within the boundaries of the territories of cultural heritage objects and their protection zones are considered in the manner of interdepartmental interaction.

4.2. Ongoing monitoring of compliance and execution officials The Committee of the provisions of these Regulations and other legal acts establishing requirements for the provision of public services, as well as the adoption of decisions by them, is carried out by the head of the Committee and officials authorized by him.

These “Recommendations” were approved and put into effect by order of the Moscow City Committee for State Expertise of Projects and Pricing in Construction dated June 28, 2007 No. 11.

INTRODUCTION

“Recommendations for determining the cost of developing an architectural and urban planning solution for a construction (reconstruction) project on the territory of the city of Moscow. MRR-3.2.41.02-07" are intended for the formation of negotiated prices for the development of architectural and urban planning solutions ( architectural project), performed and paid on the basis of the customer’s (investor’s) assignment as an independent stage of pre-design or design work on the object. The “Recommendation” can be used to determine the cost of pre-design studies for an object, carried out as additional work to the main scope of work on the formation of an Act of Permitted Use of a Plot of the Territory of an Urban Development Object (land plot) for construction and reconstruction. These “Recommendations” do not apply to cases of development of architectural and urban planning solutions as part of project documentation. These “Recommendations” have been developed to replace the “Methods for determining the cost of developing an architectural and urban planning solution. МРР-3.2.41-04".

1. BASIC METHODOLOGICAL PROVISIONS

1.1. “Recommendations for determining the cost of developing an architectural and urban planning solution for a construction (reconstruction) project on the territory of the city of Moscow. MRR-3.2.41.02-07" (hereinafter referred to as the "Recommendations") contain the procedure for calculating the cost of the main work on the development of an architectural and urban planning solution (hereinafter referred to as the AGR) and additional work related to the development of the AGR, at the basic and current price levels. 1.2. The cost of the main work on the development of the AGR expresses the cost estimate for the preparation of a set of graphic, text and demonstration materials of a certain composition, presented in Appendix 11 to the “Regulations on uniform procedure pre-design and design preparation of construction in Moscow. 2nd edition", taking into account the requirements for the composition of the materials of the booklet (album) submitted to obtain a Certificate of Approval of an architectural and urban planning solution in accordance with Section II of the Appendix to the Regulations for the preparation, approval and issuance of documents by the Moscow Committee for Architecture in the “one window” mode . 1.3. The initial base cost of the main work on the development of the AGR is determined according to the standard in shares of the value of the initial base cost of the main design work. The initial base cost of the main design work is calculated on the basis of the “Collection of base prices for design work for construction in Moscow. МРР-3.2.06.06-06" without taking into account additional work, associated costs and correction factors that take into account complicating (simplifying) design factors, as well as without taking into account the standard cost of work in the design of city-ordered objects N g.z. The initial base cost of the main work on the development of the AGR is calculated at the same price level in which the base design cost is calculated. When developing AGR on the basis of contracts concluded after December 1, 2006 (Decree of the Moscow Government of November 14, 2006 No. 900-PP), the base cost of developing AGR is determined at the price level as of January 1, 2000, 1.5. The base cost of the main work on the development of the AGR is determined on the basis of the initial base cost of the main work on the development of the AGR using adjustment factors that take into account the degree of complexity of the development of the AGR. 1.6. In cases where additional work is necessary, it is included in the assignment for the development of the AGR and is additionally paid for by the customer. In addition to the main scope, the following work can be performed in accordance with the design assignment: development of AGR options; preparation of demonstration materials beyond those provided for by the established composition; photographic works; development of a historical and architectural reference plan; carrying out additional approvals to the mandatory ones and others. Additional work on collecting and processing source data can be performed on behalf of the customer and paid for at his expense.1.7. Bringing the base cost of development of AGR to the current price level is carried out using the conversion factor (inflationary change) of the base cost of pre-design, design and other work in the design of construction projects, adopted by the Interdepartmental Council for pricing policy in construction under the Moscow Government.

2. PROCEDURE FOR CALCULATING THE COST OF DEVELOPING AN ARCHITECTURAL AND URBAN PLANNING SOLUTION
