1. 2. To the Ministry of Construction and Housing and Communal Services of the Russian Federation:

before September 1, 2017, create an interdepartmental commission to make decisions on compensation to creditors (lenders) for mortgage housing loans (loans), mortgage agents operating in accordance with the Federal Law "On Mortgage securities", for residential mortgage loans (loans), the rights of claim for which were acquired by mortgage agents, and the joint-stock company "House Mortgage Lending Agency" for mortgage housing loans (loans), the rights of claim for which were acquired by this company, losses (parts thereof) incurred as a result of the restructuring of mortgage housing loans(loans) in accordance with the terms of the assistance program for certain categories of borrowers for housing mortgage loans (loans) who find themselves in a difficult financial situation, approve the regulations on the said commission, the composition and procedure for its work;

send to the joint stock company "Housing Mortgage Lending Agency" in the prescribed manner funds in the amount of 2 billion rubles in accordance with the order of the Government of the Russian Federation dated July 25, 2017 N 1579-r as a contribution to the authorized capital of the joint stock company "Housing Mortgage Lending Agency" " for the purpose of compensation for losses (part of them) to creditors (lenders) for residential mortgage loans (loans), mortgage agents operating in accordance with the Federal Law “On Mortgage Securities”, for residential mortgage loans (loans), the rights of claim for which acquired by mortgage agents, and the joint stock company "Housing Mortgage Lending Agency" for residential mortgage loans (loans), the rights of claim for which were acquired by this company, in the event that these mortgage housing loans (loans) are restructured in accordance with the terms of the assistance program for certain categories of borrowers for residential mortgage loans (loans) that find themselves in a difficult financial situation.

3. Federal Agency for Management state property ensure, in accordance with the established procedure, an increase in the authorized capital of the joint stock company "Housing Mortgage Lending Agency" by 2 billion rubles by placing additional shares and carry out actions related to the acquisition of these shares and registration of ownership of them by the Russian Federation, in accordance with the tripartite agreement between the Ministry of Construction and Housing and Communal Services of the Russian Federation, the Federal Agency for State Property Management and the joint-stock company "Housing Mortgage Lending Agency".

4. 5. 1. 2. Reimbursement under the program is made one-time for residential mortgage loans (loans) restructured in accordance with this document, in the manner established by the joint-stock company "Housing Mortgage Lending Agency", published on its official website on the Internet.

3. Losses (part of them) of the creditor for each mortgage are subject to compensation. home loan(loan) restructured in accordance with this document, in the amount by which, as a result of restructuring in the cases provided for in subparagraph "c" of paragraph 10 of this document, the amount is reduced monetary obligations borrower under a credit agreement (loan agreement), but no more limit amount compensation, established by paragraph 6 taking into account paragraph 7 of this document.

4. Reimbursement under the program is carried out within Money provided for the implementation of the program.

5. Restructuring is carried out on the basis of the creditor’s decision on the application for restructuring submitted by the borrower to the creditor (hereinafter referred to as the application for restructuring).

Restructuring can be carried out by concluding an agreement between the creditor and the borrower (joint and several debtors) to change the terms of a previously concluded loan agreement(loan agreement), concluding a new loan agreement (loan agreement) for the purpose of full repayment of debt on a restructured mortgage loan (loan), concluding a settlement agreement (hereinafter referred to as the restructuring agreement). The terms of the restructuring agreement must comply with the requirements established by paragraph 10 of this document.

6. The maximum amount of compensation for each restructured mortgage housing loan (loan) is 30 percent of the balance of the loan (loan) calculated as of the date of conclusion of the restructuring agreement, but not more than 1,500 thousand rubles, except for the cases provided for in paragraph 7 of this document.

7. According to the decision interdepartmental commission on making decisions on compensation to creditors (lenders) for residential mortgage loans (loans), mortgage agents operating in accordance with the Federal Law “On Mortgage Securities”, for residential mortgage loans (loans), the rights of claim for which were acquired by mortgage agents, and the joint stock company "Housing Mortgage Lending Agency" for housing mortgage loans (loans), the rights of claim for which were acquired by this company, losses (part thereof) resulting from the restructuring of housing mortgage loans (loans) in accordance with the terms of the program (hereinafter referred to as the interdepartmental commission), the maximum amount of compensation for each restructured mortgage housing loan (loan) based on the corresponding application of the creditor to the interdepartmental commission can be increased, but not more than 2 times, in the manner prescribed by the regulations on the interdepartmental commission.

8. Unless otherwise provided by this document, as of the date of filing the restructuring application, the following conditions must be simultaneously met:

a) the borrower (joint and several debtors) is a citizen of the Russian Federation belonging to one of the following categories:

citizens who have one or more minor children or are guardians (trustees) of one or more minor children;

citizens who are disabled or have disabled children;

citizens who are combat veterans;

citizens who are dependent on persons under the age of 24 who are students, students (cadets), graduate students, adjuncts, residents, assistant trainees, interns and full-time students;

b) change financial situation borrower (joint and several debtors) - average monthly total income family of the borrower (joint and several debtors), calculated for 3 months preceding the date of filing the application for restructuring, after deducting the amount of the planned monthly payment on the credit (loan), calculated for the date preceding the date of filing the application for restructuring, does not exceed for each family member of the borrower ( joint and several debtor) double amount living wage established in the constituent entities of the Russian Federation in whose territory the persons whose income was taken into account in the calculation live. At the same time, the average monthly total income of the family of the borrower (joint and several debtors) in billing period equal to the sum of the average monthly income of the borrower (joint and several debtors) and his family members, which for the purposes of this subclause include the spouse of the borrower (joint and several debtor) and his minor children, including those under his guardianship or trusteeship, as well as persons indicated in paragraph five of subparagraph "a" of this paragraph, and the amount of the planned monthly payment on the loan (loan), calculated on the date preceding the date of filing the application for restructuring, increased by at least 30 percent compared to the amount of the planned monthly payment, calculated on the date concluding a credit agreement (loan agreement);

c) security for the fulfillment of the borrower’s obligations under a credit agreement (loan agreement) is a mortgage of a residential premises located on the territory of the Russian Federation, or a pledge of rights of claim to such residential premises arising from an agreement for participation in shared construction, meeting the requirements of the Federal Law "On participation in shared construction apartment buildings and other real estate and on making changes to some legislative acts Russian Federation" (hereinafter referred to as the agreement for participation in shared construction);

d) the total area of ​​residential premises, including residential premises, the right of claim to which arises from an agreement for participation in shared construction, the mortgage of which is security for the fulfillment of the borrower’s obligations under the credit agreement (loan agreement), does not exceed 45 square meters. meters - for a room with 1 living room, 65 sq. meters - for a room with 2 living rooms, 85 sq. meters - for a room with 3 or more living rooms;

e) residential premises, including residential premises, the right of claim to which arises from an agreement for participation in shared construction, the mortgage of which is security for the fulfillment of the borrower’s obligations under the credit agreement (loan agreement), is (will be) the only housing of the mortgagor. At the same time, in the period starting from the date of entry into force of the Decree of the Government of the Russian Federation of April 20, 2015 N 373 “On the main conditions for the implementation of the program of assistance to certain categories of borrowers for housing mortgage loans (loans) who find themselves in a difficult financial situation, and an increase in the authorized capital of the joint stock company "Agency for Mortgage housing lending"by the date the borrower submits an application for restructuring, it is allowed to have a total share of the mortgagor and his family members in the ownership of no more than 1 other residential premises in the amount of no more than 50 percent. For the purposes of this subclause, family members of the mortgagor include the spouse of the mortgagor and his minor children, including those under his guardianship or trusteeship. Compliance with the specified conditions is confirmed by the borrower’s application in simple written form. state register no real estate required. f) the credit agreement (loan agreement) was concluded at least 12 months before the date the borrower submits an application for restructuring, except for cases where the mortgage loan (loan) was provided for the purpose of full repayment of debt on a housing mortgage loan (loan) provided at least than 12 months before the date the borrower submits the restructuring application.

9. In case of non-compliance with no more than two conditions provided for in paragraph 8 of this document, payment of compensation under the program is allowed in accordance with the decision of the interdepartmental commission in the manner prescribed by the regulations on the interdepartmental commission.

10. The restructuring agreement must simultaneously provide for the following conditions:

a) changing the currency of the loan (loan) from foreign currency to Russian rubles at a rate not higher than the rate of the corresponding currency established Central Bank of the Russian Federation as of the date of conclusion of the restructuring agreement (for loans (loans) denominated in foreign currency);

b) establishing the lending rate not higher than 11.5 percent per annum (for credits (loans) denominated in foreign currency) or not higher than the rate in force on the date of concluding the restructuring agreement (for credits (loans) denominated in Russian rubles);

c) reduction of the monetary obligations of the borrower (joint and several debtors) in the amount of not less than the maximum amount of compensation established by paragraph 6 taking into account paragraph 7 of this document, due to a one-time forgiveness of part of the credit (loan) amount and (or) changing the currency of the credit (loan) from a foreign one currencies for Russian rubles at a rate lower than the rate of the corresponding currency established by the Central Bank of the Russian Federation on the date of conclusion of the restructuring agreement (for credits (loans) denominated in foreign currency);

d) exemption of the borrower (joint and several debtors) from paying the penalty accrued under the terms of the credit agreement (loan agreement), with the exception of the penalty actually paid by the borrower (joint and several debtors) and (or) collected on the basis of a court decision that has entered into legal force.

11. When concluding a restructuring agreement, it is not allowed to reduce the terms of mortgage housing loans (loans) and (or) charge the creditor from the borrower (joint and several debtors) of a commission for actions related to the restructuring.

12. All payments under the program are carried out in Russian rubles at the rate of the corresponding currency established by the Central Bank of the Russian Federation on the date of conclusion of the restructuring agreement (for credits (loans) denominated in foreign currency).

Due to the crisis, many borrowers lost their solvency to the bank. In the spring of 2015, a meeting of the Government was held, where the question was decided - what measures the state would take in the current situation. As a result, Resolution No. 373 of April 24, 2005 was issued. and the Housing Mortgage Insurance Agency was created.

AHML is federal agency in the form of an open joint stock company, owning 100% state capital. The agency received 4.5 billion rubles from the state to provide assistance to borrowers; subsequently (11/24/2016) additional changes were made to the program.

Acceptance of applications from those wishing to participate in the program closed on March 7, 2017. This is due to the fact that financial resources funds allocated for assistance have been spent.

By Government Decree No. 961 of August 11, 2017, assistance for those borrowers who, due to circumstances, found themselves in a difficult mortgage situation, was extended.

This is primarily due to the fact that most clients who took out a housing loan were left in a difficult situation and could not cope with payments without government assistance.

In accordance with the new program, borrowers have the right to write off 30% of the remaining debt, but in an amount not exceeding 1,500,000 rubles.

In addition, the state will write off the accrued penalty, but only if the penalty was not paid or collected according to court order.

Goals and objectives of AHML

Citizens who have taken out a mortgage loan can count on:

  1. To write off the amount in a single payment;
  2. Converting a foreign currency mortgage loan into rubles;
  3. Decrease mandatory amount upon payment of the monthly payment;
  4. Non-payment mandatory payments for a certain period and transferring them to a later date.

New program: its essence and goals

The Government explains the decision to help borrowers who took out mortgages in foreign currency by the fact that the first wave was aimed at ruble mortgages, and the 2017 program was aimed at foreign currency housing loans.

Requirements for the borrower

Borrowers must meet the following requirements:

  1. Citizenship of the Russian Federation;
  2. Personal income for everyone must be less than two subsistence minimums, with calculations taking place in three months;
  3. Housing must be purchased in Russia.

Conditions for real estate

An apartment issued with a mortgage loan must meet certain requirements. If at least one of them is not met upon request, a refusal will be received.

The requirements are as follows:

  • Housing should be the only one;
  • The mortgage agreement must be signed at least 12 months before applying for debt restructuring;
  • The cost of one square meter should not exceed 60% of average cost by region of residence.

There are also restrictions on the area of ​​the apartment.

For a one-room apartment the limit is set to 45 square meters, a two-room dwelling cannot exceed 65 square meters, and a three-room dwelling cannot exceed 85 square meters.

If he takes part in mortgage lending, then he is obliged to provide all documentation about himself and his family members.

If the borrower decides to seek help from AHML and renegotiate the debt, he needs to come to the bank branch and tell about his intention.

  4. Marriage document;

Terms and maximum amount of support

Resolution No. 961 does not indicate the period for the implementation of the program; it will end when the funds allocated to help borrowers completely dry up.

So, the news today– The Russian government will transfer from its reserves 2 billion rubles in favor of the (Home Mortgage Lending Agency), which is the government operator of the mortgage borrower assistance program. This money will be used to restructure the mortgages of those borrowers who find themselves in a difficult financial situation. According to calculations by the Russian Ministry of Construction, this money will be enough for at least 1,300 families.

The same Ministry of Construction will create a special commission that will consider incoming applications for restructuring and will have the authority, for example, to increase the amount of compensation to borrowers in some cases.

What does all of this mean

The government assistance program for mortgage borrowers was launched back in the spring of 2015, against the backdrop of financial crisis, which became especially acute at the end of 2014. Then, after the sharp collapse of the ruble, foreign currency mortgage holders suffered the most, whose monthly payments in ruble terms suddenly approximately doubled. But ruble mortgage holders also had a hard time, who, like everyone else, experienced a drop in living standards, and sometimes a significant loss of income.

The current situation was abnormal, and especially problematic cases urgently needed to be resolved somehow. The massive bankruptcy of mortgage holders was unprofitable for anyone, including banks. In the end, the bank can take away the apartment and throw people out onto the street, but what next? Firstly, it is one thing when such cases are isolated, it is another when thousands of them arise throughout the country, which will cause an unstable social situation and unrest. Secondly, the selected apartments still need to be sold somehow, otherwise they will hang on the banks like a dead weight, and the bank will also be obliged to make various payments for them.

The mortgage restructuring program was eventually launched for the following categories of mortgagers:

  • Parents and guardians of minor children.
  • Parents and guardians of disabled children.
  • People with disabilities.
  • Combat veterans.
  • Participants of the state program “Young Family”.

It is not enough to belong to any of these categories; you had to prove with documents in hand that the family’s income fell by 30 percent or more after the moment when the loan was taken out to buy an apartment. The housing itself also had to meet certain requirements.

Those who fell under these conditions were entitled to compensation from the state up to 20 per cent the cost of the apartment (but this amount could not be higher 650 thousand rubles).

What happened with the restructuring in 2017

A rather ugly story happened with the mortgage assistance program in the spring of 2017. 4.5 billion rubles were allocated for the program, and in February, due to low interest in it, a fairly large part of this amount remained in the AHML budget; the program was supposed to end by March 1. The state decided to make the conditions even more interesting in order to distribute this money to the end.

The program was eventually extended until May 31, and it was already possible to compensate 30 percent cost of the apartment (but no more 1.5 million rubles). At that moment the unexpected happened.

Mortgage holders, who had been hesitant to take advantage of the restructuring for a long time, rushed to submit applications en masse; as a result, the program was curtailed in early March (remember that it was extended until the beginning of summer), and many mortgage holders found themselves in a very unpleasant situation.

The fact is that people, in order to use the program, had to collect certain documents. And since the state informed everyone that the restructuring was valid until May, not everyone rushed to take advantage of the new conditions of the program on the very first day, and as a result, by the time the money ran out, very a large number of families were left at the stage of processing expensive documents. Many thousands of rubles were wasted.

What should mortgage holders do now?

Obviously, 2 billion rubles is not such a big amount, and the money can fly away as quickly as it did in the spring. Therefore, we advise mortgage holders who are eligible for restructuring not to hesitate, but to start filling out an application. Those who filled out documents in the spring should check the validity periods of all certificates, and if some of the documents are already available and these papers are valid, use their advantage over those who need to collect a package of documents from scratch.

The regulatory document regulating the procedure for providing assistance is Decree of the Government of the Russian Federation dated April 20, 2015 N 373 (with amendments and additions in force in 2017) “On the main conditions for the implementation of the assistance program for certain categories of borrowers for housing mortgage loans (loans) who find themselves in difficult financial situation, and increasing the authorized capital of the joint-stock company "Agency for Housing Mortgage Lending".

Conditions for providing support to mortgage borrowers (as amended before August 2017)

1 mandatory condition - categories of borrowers. The main requirement is that assistance is provided only to citizens who have minor children, or are combat veterans, or are disabled (or have disabled children).

Condition 2 - a decrease in the borrower's income.

To receive assistance, it is necessary that one of the consequences specified in clause 2.1 and one of the consequences specified in clause 2.2 occur (simultaneously).

2.1. The average monthly income of the borrower (joint and several debtors), calculated for the 3 months preceding the date of filing the restructuring application, must decrease by at least 30% compared to the average monthly income of the borrower (joint and several debtors), calculated for the 3 months preceding the date of conclusion of the loan agreement ( loan agreement), or the amount of the planned monthly payment on the loan (loan), calculated on the date of filing the application for restructuring (in ruble equivalent at the rate of the relevant currency established by the Central Bank of the Russian Federation on the same date), must increase by at least 30% according to compared to the size of the planned monthly payment calculated on the date of conclusion of the loan agreement (this paragraph does not apply since 2017 due to the publication of Decree of the Government of the Russian Federation dated November 24, 2016 N 1231);

2.2. the average monthly total income of the family of the borrower (joint and several debtors), calculated for 3 months preceding the date of filing the application for restructuring, after deducting the planned monthly payment on the credit (loan), calculated as of the date of filing the application for restructuring, does not exceed for each family member of the borrower (joint and several debtor) twice the minimum subsistence level established in the constituent entities of the Russian Federation in whose territory the persons whose income was taken into account in the calculation live. In this case, the average monthly total income of the family of the borrower (joint and several debtors) in the calculation period is equal to the sum of the average monthly income of the borrower (joint and several debtors) and members of his family, which for the purposes of this document includes the spouse of the borrower (joint and several debtor) and minor children, including including those under their guardianship or trusteeship.

Condition 4 – requirements for room area.

Assistance is provided if residential premises, including residential premises, the right of claim to which arises from an equity participation agreement:

  • By total area does not exceed: 45 sq. meters - for a room with 1 living room; 65 sq. meters - for a room with 2 living rooms; 85 sq. meters - for a room with 3 or more living rooms;
  • at the cost of 1 sq. meter of total area does not exceed by more than 60 percent the cost of 1 sq. meters of total area standard apartment for the primary or secondary housing market (respectively) in the subject of the Russian Federation in which the residential premises are located, determined according to data Federal service state statistics on the date of conclusion of the credit agreement (loan agreement).

Condition 6 – term for concluding the loan agreement.

Support is provided only for those loans for which the agreement must be valid for at least 12 months at the time of filing the restructuring application.

Restructuring can take the following forms

In order to receive assistance, the bank must provide for the following changes in conditions mortgage loan:
